- Construction Phase -Administration Of The Contract For Construction :The Construction Phase will <br />commence with the award of the Contract for Construction and will terminate when the Final Certificate of <br />Payment is issued to the Client by URSG , or the date for final completion in the original Construction <br />Contract, whichever is sooner. This task includes the following <br />The Construction Doctunents shall consist of the Client-Contractor Agreement, the Conditions of the <br />Contract (General, Supplementary and other Conditions), the Working Drawings, the Specifications, <br />and all Addenda issued prior to and all Modifications issued after execution of the Contract. Unless <br />the context indicates clearly to the Contrary, terms employed in this Agreement shall have the same <br />meaning as those defined in AIA Document A201, General Conditions of the Contract for <br />Construction, cturent as of the date of this Agreement. <br />2. URSG shall be a representative of the Client during the Construction of the Project and shall advise <br />and consult with the Client. Instructions to the Contractor shall be forwarded through URSG. URSG <br />shall have authority to act on behalf of the Client only to the extent provided in the Contract <br />Documents and this Agreement unless otherwise modified by written instrument. <br />URSG's Project Manager shall visit the site at intervals appropriate to the stage of the construction <br />to become generally familiar with the progress and quality of the Contractor's Work and to determine <br />in general if the Work is proceeding in accordance with the Contract Documents. On the basis of <br />such on-site observations as engineer, URSG shall keep the Client informed of the progress of the <br />Work, and shall endeavor to guazd the Client against defects and deficiencies in the Work of the <br />Contractor. <br />4. URSG shall not be responsible for and shall not have control or charge of construction means, <br />methods, techniques, sequences or procedures, scheduling, or for safety precautions and programs <br />in connection with the Work. URSG shall not be responsible for or have control or charge over the <br />acts or omissions of the Contractor, Subcontractors, or any of [heir agents or employees, or any other <br />persons performing any of the Work, and shall not be responsible for the failure of any of them to <br />carry out the Work in accordance with the Contract Documents. <br />5. URSG shall at all times have easy and safe access to the Work whenever it is in preparation or <br />progress. <br />6. URSG, on behalf of the Client, shall be the interpreter of the requirements of the Contract Documents <br />and judge the performance thereunder by the Contractor. URSG shall render interpretations <br />necessary for the proper execution or progress of the Work with reasonable promptness on written <br />request of either the Client or the Contractor, and shall render written decisions, within a reasonable <br />time, on all claims, disputes and other matters relating to the execution or progress of the Work or <br />the interpretation of the Contract Documents. <br />7. All interpretations and decisions of URSG shall be consistent with the intent of and reasonably <br />inferable from the Contract Documents and shall be in writing or in the form- of drawings. In the <br />capacity of the interpreter, URSG shall endeavor to secure faithful performance by the Contractor <br />and shall not be liable for the result of any interpretation or decision rendered in good faith in such <br />capacity. <br />URSG's decisions on any claims, disputes or other matters, including those in question bervveen the <br />Client and the Contractor, shall be subject to the claims procedure as provided in the Contract <br />Documents. <br />9.
