- Construction Phase -Administration Of The Contract For Construction :The Construction Phase will commence with the award of the Contract for Construction and will terminate when the Final Certificate of Payment is issued to the Client by URSG , or the date for final completion in the original Construction Contract, whichever is sooner. This task includes the following The Construction Doctunents shall consist of the Client-Contractor Agreement, the Conditions of the Contract (General, Supplementary and other Conditions), the Working Drawings, the Specifications, and all Addenda issued prior to and all Modifications issued after execution of the Contract. Unless the context indicates clearly to the Contrary, terms employed in this Agreement shall have the same meaning as those defined in AIA Document A201, General Conditions of the Contract for Construction, cturent as of the date of this Agreement. 2. URSG shall be a representative of the Client during the Construction of the Project and shall advise and consult with the Client. Instructions to the Contractor shall be forwarded through URSG. URSG shall have authority to act on behalf of the Client only to the extent provided in the Contract Documents and this Agreement unless otherwise modified by written instrument. URSG's Project Manager shall visit the site at intervals appropriate to the stage of the construction to become generally familiar with the progress and quality of the Contractor's Work and to determine in general if the Work is proceeding in accordance with the Contract Documents. On the basis of such on-site observations as engineer, URSG shall keep the Client informed of the progress of the Work, and shall endeavor to guazd the Client against defects and deficiencies in the Work of the Contractor. 4. URSG shall not be responsible for and shall not have control or charge of construction means, methods, techniques, sequences or procedures, scheduling, or for safety precautions and programs in connection with the Work. URSG shall not be responsible for or have control or charge over the acts or omissions of the Contractor, Subcontractors, or any of [heir agents or employees, or any other persons performing any of the Work, and shall not be responsible for the failure of any of them to carry out the Work in accordance with the Contract Documents. 5. URSG shall at all times have easy and safe access to the Work whenever it is in preparation or progress. 6. URSG, on behalf of the Client, shall be the interpreter of the requirements of the Contract Documents and judge the performance thereunder by the Contractor. URSG shall render interpretations necessary for the proper execution or progress of the Work with reasonable promptness on written request of either the Client or the Contractor, and shall render written decisions, within a reasonable time, on all claims, disputes and other matters relating to the execution or progress of the Work or the interpretation of the Contract Documents. 7. All interpretations and decisions of URSG shall be consistent with the intent of and reasonably inferable from the Contract Documents and shall be in writing or in the form- of drawings. In the capacity of the interpreter, URSG shall endeavor to secure faithful performance by the Contractor and shall not be liable for the result of any interpretation or decision rendered in good faith in such capacity. URSG's decisions on any claims, disputes or other matters, including those in question bervveen the Client and the Contractor, shall be subject to the claims procedure as provided in the Contract Documents. 9. URSG shall have authority to reject Work which does not conform to the Contract Documents.
