AGREEMENT <br />BY AND BETWEEN <br />THE LAKE COUNTY BOARD OF COMMISSIONERS <br />AND <br />THE VILLAGE OF HAYFIELD <br />FOR <br />STAND-BY EMERGENCY WATER SERVICE <br />THIS AGREEMENT is made as of the <br />day of <br />1998, by and between the Lake <br />County Board of Commissioners ("Purveyor"} and the Village of <br />Mayfield ("Customer"). <br />WHEREAS, Purveyor owns and operates a waterworks system <br />under the management and control of the Lake County Department of <br />Utilities; and <br />WHEREAS, Purveyor is empowered to sell and deliver its <br />surplus water to inhabitants and others outside its municipal <br />boundaries; and <br />WHEREAS, Customer owns, controls, and operates a water <br />distribution system within a district established pursuant to <br />law; and <br />WHEREAS, Customer desires to enhance the reliability of <br />its service to its own customers by establishing a stand-by <br />source of water supply; and <br />WHEREAS, Purveyor and Customer are willing to contract <br />for stand-by and emergency water service according to the terms, <br />covenants, and conditions hereinafter set forth;. <br />-1- <br />
