AGREEVIEiV"T <br />This Agreement is made by and betureen Crreg Miller Anima] Contral Services. <br />lnc., now also knoxvn as A. & S Animal Contra(, (hereinaiter collectiti•elSJ "Nliller') alid <br />Village ofMayfield (hereina.fter MayfieldVi1]age") tZiis 1'i day ofJan.uary, 2414. <br />WHEREAS, Iv1a}field Village desires to coniract with Miller to provide various <br />anLmal contrfll serNices for MayFeld Village and IVliller desires ta prOVICZe SL1CI1 SeI"V1CeS <br />upoi1 such ternls and conditions as set forth in this agreenien#. <br />Noiv therefore, in exchange of the mutual covenants contained herein the patties <br />. agree to the following: <br />1_ Term- the terms of this Agreemeut shall be for a period of two years <br />commencing on January 1, 2014 to December 31, 2015. Upon nlutual agreenaent, <br />IviayfieId Village shall have the riDht to renew this Ab eerrrent for an additional two vear <br />period with an agreed upon rate increase, not to exceed teai percent (10 %) of the nexf <br />t-wo year term. <br />2. Duties <br />A. Miller agrees to act as the ,Animal Warden for Mayfield Village and <br />shall perform such duties and have such respansibilities and aufhority as may be <br />provided by State laxx or tlie Qrdinances of 14fayfield Villkae, or any ac-ii-endmeirts inade <br />ilaereto4 for the office of -AuimaI Warden. Miller shall provide a11 equipnient, SLpp14CS, <br />persoruiel to effectively perfoim these services. lbiiller agrees to securre any and a11 <br />pei-iuits which may be required to perform the duties of Arimal Vv'arden for Mayfield <br />Viilage. <br />B. Our duties include any complaints involving donlestic animals and 1Sve <br />? nuisance wild animats which that have invaded the living space of residence. <br />Coinplaints include but are not Iimited to barl:ircF dogs, laose dogs and cais, stray dogs <br />asid cats, pet bites, pat abuse, clean up and contxol ofpet w1ii1e exereisunff, and ;ieigiabor <br />d.isputes involving pets. W e will remove stray cats and clogs and Mll hold them at our <br />facility for a period of three days. We will respond to calls involvino sick or injured <br />wildlife and haodle these in an appropriate rnanner as specified by state and 3ocal Iavvs. <br />C. We assume and cooperate in attaining compliance with and <br />enforcement of all citv, county, state and federal animal regulations_ These regulations <br />ivclude but are not limited to leash laws, nuisance laws, animal bite regulations*, animal <br />trapping and hazidling of government protected animais. We wiI[ follow up and brir.g rc <br />t1le vonclusion any vicious animal complaints. <br />• Animal bite pxocedures <br />1. Advise individuals about requirements for quai-antine of animals <br />Involved in a bite incident, <br />2. Monitor proper handling of animal bite pzocedLu-es by the <br />Guyahoga County Board of Health and treat2ng physician. <br />3. Provide quarantine facilities for stray domestac anirnals Lv}3ich <br />have bitten hnmans. If owners are located they wi?1 be held <br />responsible for atl charges imposed. <br />EXHIBIT A <br />49
