September 22, 2016 <br />Special Meeting <br />Att. #1 <br />C®MMUNITY RO®M ACCESS EASEMENT AGREEMENT <br />MAYFIELD CITY SCHOOL DISTRICT, Ohio, the Grantor herein, -whose tax <br />mailing address is 1101 SOM Center Road, Mayfield Heights, Ohio, in consideration of <br />- - - <br />- --- --the sum of one dollar -($1-00)--and -other-good -and valuable- consideration, grants -to ---- -- -- <br />____- - <br />MAYFIELD VILLAGE, Ohio, an Ohio Municipal Corporation, whose tax mailing address <br />is 6622 Wilson Mills Road, Mayfield Village, Ohio 44143, the Grantee herein, an access <br />easement for all purposes including, but not limited to, pedestrian and vehicular ingress, <br />egress, parking, maintenance, temporary and/or permanent improvements on, over, and <br />under a portion of the land owned by the Grantor and described in the deed recorded and of <br />record with the Cuyahoga County Fiscal Office Vol. 8244, pgs. 361 and 664, also known <br />as permanent parcel number 831-15-013, and Vol. 3117, pg. 304, also known as permanent <br />parcel number 831-15-014. The easement is described as more fully set forth in the legal <br />description attached and incorporated by reference as Exhibit "A," as well as the map <br />attached hereto and incorporated by reference as Exhibit "B." <br />RECITALS <br />WHEREAS, Grantor is the owner of certain real property in Mayfield Village, <br />situated in the County of Cuyahoga and State of Ohio, more particularly described in the <br />attached Exhibit "A" ("Property"). <br />WHEREAS, the Property is one of which abuts certain real property owned and <br />utilized by Grantee on which Grantee has and continues to operate a Community Room <br />that is of significant interest and value to Grantee and the general public; and <br />WHEREAS, Grantor desires to donate to Grantee an easement across a portion of <br />the Property for purposes of pedestrian and vehicular ingress and egress, parking, <br />maintenance, temporary and/or permanent improvements on, over, and under a portion of <br />the Property, including access by the Village as well as the general public to assist in <br />continuing to provide community, recreational and educational opportunities; and <br />WHEREAS, Grantee is a "public body" authorized to acquire interest in real <br />property for purposes of providing community, recreational and educational opportunities. <br />NOW, THEREFORE, in consideration of the performance and observance of the <br />conditions hereinafter contained and other good and valuable consideration, the Grantor <br />and Grantee agree as follows: <br />
