B. Grantee may enter upon the Easement for ingress and egress for all <br />reasonable and necessary construction, maintenance, upkeep and repair of <br />--" --.: "the~Property~located-with the. Easement,.,and:=:for.-any reason.-.related-to .the:-~ -~- -- :- <br />Community Room. - - - - - - <br />-- <br />--- - - -- - -- -----" - C-Grantee-arid--Grantor- shall-maintain the -Easement m a--good, clean an ----~- <br />sanitary condition, free from waste or litter and any condition that is <br />offensive to the public health, safety or welfare or that constitutes a <br />nuisance. <br />D. Grantee and Grantor shall not conduct, nor permit any member of the public <br />to conduct on the Property any offensive, noisy, dangerous or illegal <br />business or use or other activity constituting a nuisance. <br />5. Limitation on Use of the Easement. <br />Access on, over or across the Easement includes access by motor vehicle, bicycle, <br />and foot or other non-motor vehicular means for purposes of pedestrian and vehicular <br />ingress and egress, parking, construction, maintenance, upkeep, repair, temporary and/or <br />permanent improvements on, over, and under a portion of the Property, including access <br />by the Village as well as the general public to assist in continuing to provide community, <br />recreational and educational opportunities that may be established within the Easement, or <br />for emergency access, for wildfire and structural fire suppression and to facilitate search <br />and rescue operations. <br />Such use by Grantee is nonexclusive, and Grantor may also use the Easement area <br />consistent with Grantee's rights under this Agreement, including but not limited to <br />Grantor's reciprocal right to use the Easement area for vehicular ingress and egress and <br />parking purposes, and Grantor's right, subject to all present and future local, state and <br />federal laws, regulations and orders, to manage, maintain, and modify vehicular and <br />pedestrian ingress and egress as it pertains to Grantor's school operations within the <br />Easement and on its Property. <br />6. Grantor's Representations. <br />Notwithstanding that the Easement granted herein is without warranty; Grantor <br />represents that it is the current owner in fee title to the Property, and that it has full legal <br />authority to grant this Easement to Grantee free of liability for any lien or encumbrance <br />previously placed thereon by Grantor. <br />3 <br />
