Mr. 'Jllhiting stated that it was merely a question tether general <br />funds should be used for the improvement of dedicated public highways within <br />the Village of Mayfield. <br />Mr. Oatess stated that two funds are ai~ailable for the repair of <br />dedicated public highways. within the Village. of hayfield, therefore an3r repairs <br />should be made from these two funds® ~°. Oates-stated that. salaries were <br />being paid from these funds for those.. employees of the. Village of Mayfield <br />who are engaged in the repair-of public highways within the Village of Mayfield, <br />therefore if these salaries were paid from. general funds there would be <br />something left in these funds-to effectuate .some sort of permanent repairs to <br />these public highways, since at present these funds. are admittedly insufficient. <br />Mr. Whiting suggested that the Village of Mayfield is only obligated <br />to pay 2~ of the cost plus t•he cost of ..intersections when duly dedicated public <br />highways within the-Village of Mayfield are permanently improved. <br />Mr. Oatess suggested that in all past years all the road funds have <br />gone into these public highways. <br />Mr. Endres stated that these are duly dedicated public highways <br />within the Village of Mayfield and that the Village of Mayfield has certain <br />legal obligations with respect to the.. condition. of. these public highways. <br />Mr. Edelman stated that the statutes of the State of Ohio require a <br />municipal corporation to care for and supervise and control public highways <br />within the municipality and to cause-.them to be kept open, in repair, and. <br />• free from nuisanc®, and the municipal corporation will be liable for injuries <br />caused thereby if it performs thi.s.:duty negligently. <br />It was moved by Mr, Whiting and seconded by Mr. Oates that the <br />expenditures from the general fund proposed in.the proposed budget for the <br />permanent improvement of duly dedicated public highways. within the Village of <br />Mayfield be deleted. <br />Roll Call: Ages ~- Messrs Swanson, VPhi.ting & Oatess. <br />• Nays ®Messrs Endress., .Taglor,- Beard and Mayor Hodgson. <br />Motion not carried <br />Mr. Whiting stated that by the estimated expenditures in the proposed <br />budget a 3 mill levy fo.r the. ensuing two year period would be sufficient. <br />Tt was moved by Nr. Oates and seconded by Mr. Wlv.ting that the rules <br />of law requiring Resolution No. 255 to be read on three separate occasions be <br />suspended. <br />Roll Call® Ayes -Messrs.
