He suggested that, inasmuch as culverts under driveways <br />would 'oe necessary, the property owners be asked to deposit with the clerk <br />sufficient money for this pipe, and the village buy and install thera as <br />the work progressed. Mr. Rogers brought up the subject of the county <br />accepting this road, and the fact that the part of the road used at present <br />was the T`iayfield Heights side of the road. Ou.r Engineer stated that this <br />acceptance by the. county had always been held up because of the inability of <br />Lyndhurst to obtain a right of way over a portion of the road, but that <br />this had no`s been accomplished and 1`'Ta.yor Elbrecht was working on the prospect <br />of County Acceptance. He suggested that our mayor get in touch z~rith Mr. <br />Elbrecht for further information. - <br />Oiir solicitor brought out that, inasmuch as the portion of the road <br />now in use was in Mla.yfield Heights, the village could not legally spend <br />money to put it in repair. -Mayor Endress then recommended that the committee <br />report back to T'k.yfield Heights that our village was unable to participate <br />in any project at this time. ~'Tr. Wieland was authorized to make the road <br />passable over the Tlayfield Village side. <br />Mr. Ovi.att, attorney at law representing Mr. and Mrs. Leonard I~1CGurer <br />of 1090 Washington Blvd. in our village, read to Council a letter which he <br />had written to the Mayor and Clerk. He brought out that the McGurers were <br />unable to obtain a guaranteed title to their property, as, the Washington <br />Boulevard Extension appeared to be a figment of some one's imagination . <br />The thirty foot strip used a s ingress and egress to the property and <br />supposedly called "The Washington Boulevard Extension" had been sold at <br />auditor's sale and acquired by Mr. T~7iller separately from acreage to the <br />~lorth which he has been attempting to develop. Mr. Oviatt then asked <br />Council to consider the plight of his client and the two other property <br />owners on this proposed roadway in considering the platting of the Miller <br />developrment.- Cur Engineer then brought out the Miller Plat and showed it <br />to Council. Mr. ~riatt wanted Washington Boulevard accepted as a platted <br />street at the same time as the Miller Plat., or an easement or- deed given <br />to the village over this proposed street. It was moved, by T'~~°. Wh.iting, <br />seconded by NTr. Strater, that action on the.T'liller plat be suspended <br />until our Solicitor could be satisfied that the three property okmers on <br />Washington Boulevard Extension are protected in the matter of access to <br />Ridgebury Boulevard and the future interest of the v~.llage and development <br />company are protected. <br />Roll Call: Ayes - T'2essrs Swanson,strater,Whiting,Beard & Oatess. <br />Nays -None. - <br />Motion Carried <br />The matter of a plat for I'Iaplegrove was brought up and our Engineer <br />showed Council the vacating plat of this street. The Cler1L signed and <br />sealed this plat and it tress given to our Engineer to be filed and recorded <br />at the County Auditor's Cffice. <br />The T'Tayor then read a Petition from residents of SOM Center Road <br />petitioning Council for water from the Northerly line of Highland Road <br />I~orth to Schulz's property, 88/ of the cost of this project to be <br />assessed abutting property owners. At this point our Solicitor, Ivlr. <br />Edelman, brought up the fact that there tress insufficient money in the <br />water main trust fund to carry out this project, and some thought should <br />be given to selling sufficient of our remaining ~1~0,000.00 bonds to <br />2. <br />
