Mayor Endress then read a letter from Kenwood Builders, Inc, asking <br />f or a list o£ work to be corrected together with a list of locations. A <br />representative from Itenwood Builders said that he had a call from Garcione <br />saying that he did not think any funds in escrow could be used for engineering <br />fees as they were trust funds. Mr. Edelman suggested that Mr. Peterson give <br />them an estimate of the work and they could then put up funds with the Clerk <br />f or engineering fees. Mr> Peterson said he did not have authorization to <br />inspect these roads by Council but would be glad to take care.of them if funds <br />were available. This inspection would be approximately $150.00. <br />Mr. Koerber said that there was $2000.00 in the fund for repairs and <br />this would come under the heading of repairs. They would, however, put up <br />money with the clerk for engineering fees. <br />It was then moved by Mrs. Brown, seconded by Mr. Grootegoed, that <br />our Engineer`inspect'the roads in Kenwood Subdivision when funds were <br />available with the Clerk. <br />Roll Call: Ayes - Messrs Zorn,Wedler,Bennett,Brown,Grootegoed & Belzer. <br />Nays - None. <br />Motion carried <br />Mayor Endress then reported that at our last meeting we had placed <br />an ordinance on High Rise Apartments on its first reading and asked Council to <br />consider the matter. Mrs. Brown wished to know what was the use of reading <br />the ordinance again i£ it wasn't going to pass. She said that she could not <br />see the point in fooling around, Mr. Zorn said that there was another . <br />organization that had different ideas about this and he wanted to hear them. <br />Mr. Grootegoed asked if a taxpayer's suit could be instituted if the ordinance <br />passed, Mr. Edelman said that this ordinance did not cover any particular <br />piece of land and another hearing and another ordinance would have to be <br />passed before considering Mr. Grootegoed's question. He said, however, that <br />Council could put anything on a referendum that they wanted. . <br />Mr. Edelman then read Ordinance No. 721 to Council for the second time, <br />which was amended by omitting the emergency;clause and by adding a provision <br />for a 'performance bond. <br />There was a great deal of discussion in general about this ordinance, <br />its purpose and powers and what other procedures would take place if high rise <br />apartments were added to our Zoning Ordinance. Mr. Edelman explained again <br />and again, that this did not zone any parcel of land for High Rise Apartments, <br />but merely added this category to our Zoning Ordinance and placed it in a <br />special class. Mr. Edelman then told the audience who had been arguing with <br />Council about petitions, polls and canvases, that Council was elected by the <br />people to handle the aff airs of the village and it was,up to Council to <br />decide on this particular issue, that it was Council and not a Gallup Poll . <br />that ran the village, that, while Council should give respectful consideration <br />to the arguments and views pro and con advanced by the citizens: of the Village, <br />the responsibility in the last analysis falls on the shoulders of the Councilmen. <br />2.
