Judge Thomas dismissed the case of Scheer vs. The Village of Mayfield <br />but Mr. Scheer was going tQ try and take this case to a higher court. Mr. <br />Edelman also reported that the case of Maynard vs. The Village of Nlayf i'e-ld <br />and County of Cuyahoga is still p?ending in the Lyndhurst Court. <br />The Sun Oil Company signs again came up for discussion and the Sun <br />Oil Co.,,presented pictures, of,other signs in business areas in the Village <br />that estended over the sidewa`lk. Mr. Mason said that, as the'`Tillage owned <br />the sidewalk area, it should have control over the signs. Mr. Shaw said he <br />would like to have ,our sign ordinance re-drawn to cover this but did not like <br />to see the Sun Oil penalized in this matter. Zt was then movedby'Mr. Shaw, <br />seconded by Mr,. Sloan, that the rules of law requiring a Resolution to be <br />read on three,separate occasions be suspended with regard to the Resolution <br />having its first reading at the December meeting and granting permission <br />f or this sign. <br />Roll Call: Ayes - Messrs Shaw, Walker, Sloan, Mason, Busa & Davis. <br />Nays - None. " <br />Motion carried <br />Rules Suspended <br />,It was moved by Mr. Shaw, seconded by Mr. Sloan, that the Resolution <br />be approved and passed as read. <br />Roll Call: Ayes - Messrs Shaw, Walker, SToan &z Davis. - r <br />Nays - Nlessrs Busa and Mason. <br />' Motion carried <br />Resolution Passed <br />'Mr. Morgan and Mr. Bardou were.again.at.Council and the matter of <br />drainage ditch in back of Mr. Bardou's came up. There was a great deal of <br />discussion on this matter in Council. Mayor Bennett then requested that all <br />parties come to a definite and final.agreement on this drainage problem. An <br />Agreement was finally reached with the Neroni people. This agreement was <br />written and signed on the development map. This agreement reads as follows: <br />Elaren, Inc. Wi11; . .. _ <br />1. Grade property of Morgan and Bardou,at the grade of the <br />•• center of adjoining proposed road. <br />2. Present ditches (two) filled and covered with fifteen <br />inches of.top soil up to present grade of land to rear of <br />Bardou and Morgan dwellings within six months. 3. Morgan drain to be extended to new storm sewers. <br />4-.
