fact that in his opinion the State had done nothing that was not in good practice
with present day engineering'and felt that there was no cause f or damage from
diverted water. Our Engineer again took the stand that what taas done on the
drainage problem conformed to good engineering practice and was within the
sights of i:he State;
Mr, Schulz brought out the fact that there was a three_f oot drainage
tile brought out to a water course that never had more than a trickling stream
and that this three foot tile-was mostly above ground and the State'was building
buttresses of stone to keep the water within the small stream; 'Mro'Schulz said
that in time of rafn, with the entire Freeway, the road drains and every other
possible water drain being f unnelled into this stream;eould nof help but spread
over the land and inundate acres of landa Mra Schtriz' said that? the Freeway was
a North-South dam across the back of his property, and with the cuti:ing of trees
and packing of land- it constituted a water diversiori and-was iinpossible to
contemplate in times of severe weather. -Mr. Scliulz-read volumes of statistics
on the mattes and mentioned people south of him in a similar position who were
already in court over?the matter. Mr. Schulz felt that Council was-derelict
in duty when they allowed this to get' by-them and felt, that the Village should
do something about it. Our Engineer again poiritedout tliat in his est3mation
ther.e was no Eaater-diversion. That this was good engirieering practice. Mr,.
Edelman said that if Mr. Schulz could prove water diversion, he had good grounds
f or redress; but otherwise he had to take the water and pass it along, that
th'is eaas a civ'il a£fair between Mro Schulz and -the Stateo
There was a great deal of speculation in Council as to whai: would happen
when the water tried to get across SOM Road, as it was felt that, the culvert was
so inadequate as to be useless.
Mro_ Bennett asked about the inspection made by our Engineer and wondered
why Council was not made aware i:tiat an inspeetion hacl been madeo It was tiien
moved by Mr. Bennetta seconded by Mr. Belzer, that our Engineer,go with Mr. Schulz
for two or three days and walk over the property and see what he could find oute
- -
. ,
.
Ro11 Call; Ayes - Messrs Zorn, Wedlera Bennett, Mason, Sloan & Belzer.
_ Nays - None.
Motioti carried
There being no further business to come bef ore Council; upon-motion
macle and duly put' Council adjournedA - =
Attest:
?
