~. ~~ <br />-4- <br />Mr. Relic stated that notes for the amount of $29,570.00 will <br />be reissued and can be paid back for the net amount due and we <br />can issue bonds pending legal litigation. Notes can be purchased <br />at the interest rate of 7%-tax free. <br />Mr. Schulte, seconded by Mr. Prager, made a motion to suspend <br />the rules of law requiring a resolution to be read on three <br />separate occasions. <br />Roll Call: AYES: Messrs., Barclay, Bennett, Bluhm, Mrs. Negrelli <br />and Messrs., Prager and Schulte <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Prager, seconded by Mr. Schulte, made a motion to adopt <br />Resolution 902. <br />Roll Call: AYES: Messrs., Barclay, Bennett, Bluhm, Mrs. Negrelli <br />and Messrs., Prager and Schulte <br />NAYS: None <br />Motion Carried <br />Resolution Adopted <br />Resolution 903, entitled; "A RE5OLU`1'ION AUTHORIZING AND DIRECTING <br />THE LAW DIRECTOR TO PROVIDE A DEFENSE IN LITIGATION PENDING IN <br />THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF <br />OHIO, EASTERN DIVISION, CASE #C73-1143, AND DECLARING AN <br />EMERGENCY", was introduced by Mr. Barclay.` <br />Mr. Byrnes stated this resolution was redrafted to incorporate <br />language of state code and requires a majority of council to pass. <br />Mr. Prager, seconded by Mr. Schulte, made a motion to suspend the <br />rules of law requiring a resolution to be read on three separate <br />occasions. <br />Roll Call: AYES: Messrs., Barclay, Bennett, Bluhm, Mrs. Negrelli <br />and Messrs., Prager and Schulte <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Prager, seconded by Mr. Barclay, made a motion to adopt <br />Resolution 90 3. <br />Roll Call: AYES: Messrs., Barclay, Bluhm, Mrs. Negrelli and <br />Messrs., Prager and Schulte <br />NAYS: Mr. Bennett <br />Motion Carried <br />Resolution Adopted <br />
