~. t~ <br />-5- <br /> Mr. Byrnes replied no, but a timely meeting to act in due time could <br /> not be held. <br /> Councilman Grogan also stated that he was concerned about the time <br /> that this appeal would take; that he estimated it vaould take approxi- <br /> mately twelve months fo r this appeal to be heard in the Eigth District <br /> Court of Appeals. He f urther noted that all worlc in the Industrial <br /> Parlc is stopped by Cour t order. The Councilman emphasized that he felt <br /> this appeal should not stop the administration from working out the <br /> problem of drainage wit h the residents on SOM Center Road. Only if <br /> the problem was worked out with the residents can the restraining order <br /> be lifted by the Court. Councilman Grogan further stated that the <br /> chances of the appeals court overturning the decision were slim in his <br /> estimation. Therefore, we will still be faced with solving this drain- <br /> age problem next year. Mr. Grogan asked that the administration proceed <br /> to vrork on the problem and report back to Council as soon as possible. <br />Mayor Beebe stated that the overall feeling of Council was to authorize <br />an appeal. <br />Mr. Bennett stated that he would like to go on record saying that he <br />was against filing an appeal. The Village is spending too much money <br />for this law suit and not resolving the actual problem. <br />Mr. Schulte, seconded by Mr. Busa, made a motion to adopt Resolution 931. <br />Roll Call: AYES: Messrs., Barclay, Busa, Flynn, Grogan, Mrs. Negrelli <br />and Mr. Schulte <br />NAYS: Mr. Bennett <br />Motion Carried <br />Resolution Adopted <br />Resolution 932, will be voided and placed as a motion only. <br />Mr. Busa, seconded by Mr. Grogan, made a motion to authorize the <br />advertisement for bids for sale of three used police cars. <br />Roll Call: AYES: Messrs., Barclay, Bennett, Busa, Flynn, Grogan, <br />Mrs. Negrelli and Mr. Schulte <br />NAYS: None <br />Motion Carried and Passed <br />Resolution 933, entitled; "A RESOLUTION AUTHORIZING THE FINANCE DIRECTOR <br />TO REQUEST TENDER OF BIDS FOR CONSTRUCTION OF A FIVE-FOOT BIFCE PATH", <br />was introduced by Council as a Whole. <br />Mr. Busa, seconded by Mr. Schulte, made a motion to adopt Resolution 933. <br />Roll Call: AYES: Messrs., Barclay, Bennett, Busa, Flynn, Grogan, <br />Mrs. Negrelli and Mr. Schulte <br />NAYS: None <br />Motion Carried <br />Resolution Adopted <br />
