~~ <br />-g- <br />Mr. Bennett said that at one of the Caucus' he asked Mr. Byrnes what <br />the cost of a transition would be? Mr. Byrnes replied very little. <br />Mr. Barclay stated that the fees presented by Mr. Grogan suggesting <br />other communities charged locaer fees was not necessarily a true <br />figure. A $35 fee is for municipal court dealings and other firms <br />c,~ere hired for higher courts. <br />Mr. Grogan stated that is not necessarily true. <br />At this time Mr. Grogan asked for a roll call vote on the motion. <br />Roll Call: AYES: Messrs., Barclay, Bordonaro and Schulte <br />NAYS: Messrs., Bennett, Busa, Flynn and Grogan <br />Motion Defeated <br />The Law Director was not reappointed. <br />Ordinance 77-13, entitled; "AN ORDINANCE PROVIDING FOR THE COMPENSATION <br />OF THE LAW DIRECTOR", was introduced by Mr. Barclay for first reading. <br />Mr. Grogan ruled the introduction of Ordinance 77-13 out of order. <br />Mr. Campanella advised that .in his opinion the ordinance can be intro- <br />duced by a Councilman since it was not being put to a vote. <br />Mr. Bennett stated he feels it is a biased opinion. <br />Mr. Barclay stated that the Charter shows a Councilman can intro- <br />duce an ordinance. <br />Mr. Grogan said he has the right to rule on accepting or rejecting <br />since no one has seen the ordinance. <br />Mr. Barclay wished to go on record showing that he introduced Ordinance <br />77-13 for first reading. <br />Y~Lr. Grogan stated that the Chair can rule and therefore ruled the <br />ordinance out of order and rejected the introduction. He said the <br />ordinance is in conflict with Ordinance 77-4. <br />GENERAL COMMENTS: <br />Mr. Campanella representing Mr. Byrnes stated that their law firm will <br />advise the courts that they will be withdrawing as legal counsel for <br />litigation. <br />Mr. Barclay stated to Mr. Grogan, "my advice has been requested regard- <br />ing appointing you as the Law Director subsequent to your election as <br />a Councilman. Would you care to comment publically as to whether <br />you had solicited the appointment of Law Director since you were <br />elected as a Councilman"? <br />Mr. Grogan replied "no comment°'. <br />
