Barclay. <br />I~Ir. Grogan said the Judgement entry was made on July 26, 1977 and if <br />an appeal is to made within 30 days, time was running out. <br />Ivir. Barclay said there is not time to get it on the ballot this fall. <br />I^?r. Grogan questioned as to where we were caith these cases? <br />ri?r. Barclay said we had three choices: <br />(1) Appeal <br />(2) Council to take action by Ordinance <br />(3) People could have put on the ballot by Initiative Petition <br />I~ir. Grogan said that the expense involved in another appeal after two <br />Judges have alre.dy decided against the Village seemed senseless. Is <br />there no end to litigation? This Village needs no more. <br />n?a.yor Beebe commented that it was common ]cnowledge that the people <br />wanted to keep it residential. <br />I~?r. Bordonaro asked if it were possible to appeal now and drop the pro- <br />cedings later? <br />T~ir. Grogan said to file a Brief is very expensive and it has cost us <br />$25,000 (approximately) over the past five years and still the two <br />Judges have decided against the Village. <br />If?r. Busa suggested it be put on the agenda for the next meeting. <br />i~Ir. Barclay, seconded by I~r. Schulte, made a motion to suspend the rules <br />of law requiri.ng~a resolution to be read on three separate occasions. <br />Roll Call: AYES: L~iessrs., Barclay, Bordonaro, and Schulte <br />P7AYS: 1~Iessrs., Bennett, Busa, Flynn and Grogan <br />_,NTotion Not Carried <br />It was decided that a Special T~Ieeting would be held Tuesday, Autust 23, <br />1977 to consider Ord. 77-33, Ord. 77-32, Res. 996, Res. 995 and any <br />other matter that may come before Council. <br />
