MINUTES OF PUBLIC HEARING <br />Village of Mayfield <br />Jantxary 13, 1972 <br />The Council of the Village of Mayfield met at a P_?ublic <br />Hearing at Mayfield Village Ha11 on Thursday, January 13, <br />1972 at 8:10 P.M., Mayor Bob Beebe, presiding. ? <br />Roll Call: Present: Nlayor Beebe, Messrs. Boger, Bordonaro, <br />Braun, Davis, Leech and Schmidt. <br />Absent: None. <br />Also present were Messrs. D"Agostino, Edelman, Hovancsek <br />and Relice <br />Notices of this Public Hearing were published in the news- <br />paper, introduced to council and read on two separate occas- <br />ions. <br />Mr. Edelman read the proposed Ordinance #71-36, Entitled: <br />"AI1T ORDINANCE TO AMEND SECTIOIV 31.6 OF ORDINANCE N0. 960, <br />AMENDING ORDINANCE NO. 159, THE ZONING ORDINANCE OF THE <br />VILLAGE'OF MAYFIELD, BY PROHIBITING ENTRANCE AND EXIT <br />DRIVEWAY5 IN LOCAL BUSINES5 DISTRICTS LERDING TO AND FROM <br />LOCAL RE5IDENTIAL STREETS." <br />Proponentss Mr. James Smith, 737 Sandalwood Drive: "This particular <br />ordinance, I believe, was introducedby the council.pur- <br />suant to a suggestion or request by the Citizen's Master <br />Plan Committee, highlighted by a situation proposed for a <br />commercial development at Sandalwood and 50N! Center Rd. <br />I request council to give consideration that the same <br />apply in the future on almost any situation where you <br />have commercial/industrial or anything by a residential <br />area. Traffic of a commercial nature where side streets <br />are narrow and sid:ewalks that are used by children or <br />pedestrians is a particularly hazardous situation. Semi= <br />trucks do not have room on narrow streets to turn. To <br />get out of a commercial area they have to back them out. <br />Residents are citizens of N3ayfield Village and any kind <br />of vehicnlar traffic is better to exiting off of the wide <br />thorough-fare and not side streets. Other communities do <br />this and we should do the same." <br />Opponentst <br />Mr. Richard Van Curen: "Has any ruling as to the con- <br />stitutionality of this ordinance been ordered? Secondly, <br />if you have heard that it constitutional will you back up?_ <br />that, too? If the village is in litigation will you do <br />it at no cost to the village? And will you, Mr. Leech? <br />(Mr. Leech answered: "I:d have to research it,further. <br />I have no basis.") Mr. Edelman, in your opinion, it is
