118 <br />extra work being done that had not been authorized. He felt the contractor <br />was trying to raise the cost and he told him he would not pay for a job he <br />did not approve. <br />Mr. Feneli explained that any contractural items are a private dispute between <br />the contractor and the resident. He said that the only way Mr. Amendola could <br />issue a"stop work order" would be if the work did not meet our code and that <br />whether or not it met with Mr. March's satisfaction would have no bearing on it. <br />Mr. Feneli said that any threats that were made to Mr. March regarding a possible <br />menacing charge should be handled i by the Police Department. He noted that it <br />would be a misdemeanor charge, not a criminal (felony) offense. <br />Mr. Hovancsek said regarding permits taken, according to our code contractors <br />are required at various intervals during construction to request an inspection <br />by the Village. Unfortunately in this instance, much of the work was done, <br />the building inspector was called after the fact. He said the work was done <br />and covered up, which is the contractor's problem. <br />Mr. Feneli stated if what Mr. Hovancsek said was true, Mr. Amendola would have <br />the authority to. make the contractor dig up the area for inspection and to cover <br />it back up at his expense. Mr. Amendola would have the authority to issue a <br />stop-work order. Mr. Feneli explained that the Village requires a contractor to <br />post a bond when they are doing work for the Village. The Village does not require <br />contractors to post bonds for work contracted by residents. That would be up to <br />the individual resident. <br />Mr. March questioned if he might have trouble selling his home if an inspection <br />showed this problem which would require it to be fixed in accordance with Village <br />code. <br />Mr. Feneli said the Village does not have a point-of-sale inspection requirment. <br />Mr. Amendola explained that he has been trying,unsuccessfully to reach the <br />contractor and will keep trying. <br />Chief Stevens explained if Mr. March wants to the Police Department to pursue <br />the threat made to Mr. March, that he would have to file a complaint. They <br />would be happy to take the report. <br />Mr. March asked if someone could advise the contractor if he persists what law <br />he would be breaking. <br />Chief Stevens clarified this is regarding the matter of the threat.made to Mr. <br />March only. <br />Mr. Basile and Mr. Petschauer said they felt Mr. March should file 'a complaint <br />with the Police Department. Discussion was he1d. <br /> <br />Mr. Amendola said he will try to set up a meeting with the contractor; he felt it <br />was best if he met with the contractor by himself and possibly Chief Stevens.
