u ; i <br />187 <br />Regular Council Meeting <br />12/21/87 <br />Page 3 <br />Spaghetti Company Truck Parked in Front Lot - Mr. Amendola said that the <br />truck has not been parked in the front of the lot since he returned <br />from vacation. <br />Century 21 and Kotoch-Buildirig - Mre Amendola said that Mayor Carmen <br />wants to discuss this topic at the next Council Caucus. <br />Driveway Drain at Georgian Center - Mr. Amendola said that this work <br />must be done by hand and not by machine. He said that the Service <br />Department will try to do the work this week. <br />Highland Road Berms - White Road Ditches - Mre Basile said that he <br />received a letter stating that the County will take care of the berms on <br />Highland Road and the ditches on White Road in the spring. <br />Second Reading of Ordinance-No. 87-42, entitled; "AN ORDINANCE ENACTING <br />SECTION 549.11 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, <br />PERTAINING TO REPLICAS OF HAND GUNS OR OTHER FIREARMS AND DECLARING AN <br />EMERGENCY." Introduced by Mayor Fred N. Carmen. <br />Third Reading of Ordinance No. 87-33, entitled; "AN ORDINANCE ENACTING <br />SECTION 1149.061 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, <br />PERTAINING TO THE CESSATION OF USE OF A NON-CONFORMING USE, REPEALING <br />ALL ORDINANCES INCONSISTENT HEREWITH AND DECLARING AN EMERGENCY." First <br />Reading 11/2/87, Second Reading 11/16187.) <br />Mr. Flynn, seconded by Mr. Basile, made a motion to enact Ordinance Noo <br />87-33. Mr. Amendola suggested that discussion be held regarding this topic at <br />the next Ordinance Review Committee. <br />Mr. Petschauer agreed with Mre Amendola's suggestion and stated that he <br />did not entirely understand the proposed legislation. <br />Mr. Feneli explained that since there is nothing in our Codified <br />Ordinances that addresses the issue of when a non-conforming use becomes <br />non-conforming, that we must refer to the Ohio Revised Code. He cited <br />an example of a non-conforming use and explained that the proposed <br />legislation would speed up conformity to the code. Mr. Feneli said that <br />the legislation would require non-conforming uses that remain in a state <br />of unuse for a period of six consecutive months to conform to our <br />present code, <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Ordinance Enacted <br />Third Reading-6f-Ordinance-N6.-87-35, entitled; "AN ORDINANCE ENACTING <br />CHAPTER 763 OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE OHIO, PER- <br />TAINING TO NOTIFICATION OF USE OF PESTICIDES." Introduced by Council <br />President Santo Basile. (First Reading 11/2/87, Second Reading <br />11/16/87.) <br />Mr. Petschauer, seconded by Mra Rinker, made a motion to enact Ordinance <br />No. 87-35. - <br />Mr. Basile asked how the companies using pesticides will be notified.
