35 <br />MINUTES OF A SPECIAL MEETING OF COUNCII. <br />. February 27, 1991 <br />7:40 p.m. <br />The Council of Mayfield Village met in a Special Session on Wednesday, February 27, 1991, at <br />seven forty p.m. (7:40 p.m.) in the Council Chambers at the Mayf'ield Village Hall. Council <br />President Bruce Rinker presided. <br />ROLL CALL: Present: Mrs. Cinco, Mr. Ferrante, Mr. Flynn, Mrs. Mills, Mr. Pietrafese, and <br />Mr. Rinker <br />Absent: Mr. Basile <br />Also Present Were: Mr. Amendola, Mr. Hovancsek, Mr. Patrick, Mr. Ramos, and Mrs. <br />Martin <br />Mr. Rinker stated that Resolurion 91-21 is up for passage this evening and asked Mr. Ramos to <br />read the title. <br />First Reading of Resolution 91-21, entitled; "A RESOLUTION REPEALING RESOLUTION <br />91-20, PERTAINIlVG TO TBE CONTRACT WITH.D D D ENTERPRISES, INC. FOR TBE <br />REMOVAL AND REPLACEMENT OF TBE WII.SON MILLS ROAD DRAINAGE <br />STRUCTURE AND DECLARING AN EMERGENCY" Introduced by Mayor Cannen and <br />Council as a Whole. <br />Mrs. Mills, seconded by Mrs. Cinco, made a motion to suspend the rules of Council requiring a <br />resolution to be read on three sepazate occasions. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Morion Carried <br />Rules Suspended <br />Mrs. Mills, seconded by Mrs. Cinco, made a morion to pass Resolution 91-21. <br />Mr. Hovancsek stated that he attended a recognirion dinner at Landerhaven last Friday evening and <br />spoke with Tom Neff who informed him that the County cannot take legislative action until a <br />formal letter of request is received. Although he submitted plans in mid-January and followed up <br />with estimates, he failed to submit a formalletter of request for a resolution to the Commissioners. <br />Therefore, the Village will have to nullify the contract with D D D Enterprises, Inc: until the <br />County takes action. Mr. Hovancsek said that he has spoken with the contractor and the contractor <br />has no problem with the delay. <br />Mr. Rinker questioned the rime frame. <br />Mr. Hovancsek stated that the contract provides for 60 days. However, he delivered the formal <br />letter of request to the County Engineer's office at 9:00 a.m. last Monday. They forwarded it to <br />the Comtnissioner's Office as everything must be followed to the letter of the law. The <br />Commissioner's will formally present it at their meering on March 4. He will see that a copy of the <br />County's legislation is available for Council for a Special Meering before their Caucus. The <br />legislation must then be given back to the Commissioners who must wait the minimum of one
