65 <br />Regular Council Meeting <br />4/15/91 <br />Page Five <br />A man in the audience asked if the swales that aze real bad have been identified. <br />Mr. Hovancsek said no. <br />Mayor Carmen said there are about 36 properties. <br />A man in the audience said the recent rain brought a lot of water to the area. <br />Mr. Hovancsek said he will look at the area. <br />Mayor Carmen said he does not have Council authorizarion regarding the proposals he is <br />suggesting, and asked them to express their feeling. <br />Mrs. Mills said she needs time to think about it and needs to know the cost <br />Mrs. Cinco said, (before knowing the cost) she thinks a lot of thought has been put into the proposal and thinks it is a fair way to do it. She said we do not have any one way that will make <br />everyone happy. Ultimately, it will rest with the home owners and she hopes they can come up <br />with a way to make everyone happy. <br />Mr. Ferrante said he feels like Mrs. Cinco. <br />Mr. Rinker said he has heard a fair agreement defined as when both sides walk away grumbling. <br />He realizes the dollars are the bottom line figure with everyone. _ <br />Mr. Flynn said he thinks it is a good concept. After looldng at the figures, he hopes Council will <br />move ahead with the 50-50 proposal. <br />Mr. Basile said he needs to see the dollar amount before making a deternunarion. <br />Mr. Pietrafese said he thinks if oprion #2 is exercised that the Village should be held harmless. <br />Mrs. Cinco said she would like to see option #1 chosen so that the problem would be completely <br />taken care of now. <br />Mr. Ferrante said another point the representatives from the home owner s associarion can make is <br />that we can force them to comply with our ordinance, but we do not have to do that. <br />Mr. Hovancsek said the initial swales were put in when the subdivision was made by the <br />developer. After that, as builders moved into the area the swales got torn up. <br />Mayor Cannen asked what kinds of bonds are srill in place. <br />Mr. Hovancsek said the bond posted by developer was long gone. The only bond we may have is <br />a performance bond to be used if there is any damage done to Village property. <br />Mr. Amendola explained the bonds were held unril the houses were occupied. <br />Discussion was held.
