-d J -5 <br />Regular Council Meeting <br />8/19/91 <br />Page Five <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />First Reading of Ordinance No. 91-37, enritled; " An ordinance establishing the Village Trail Fund <br />and Declaring an emergency." Introduced b y Mayor Carmen and Council as a Whole. <br />Mr. Ferrante, seconded by Mr. Basile, made a motion to suspend the rules of Council requiring an <br />ordinance to be read on three separate occasions. <br />ROLL CALL: AYES: All <br />NAYS: None Morion Carried <br />.Rules Suspended <br />Mrs. Mills, seconded by Mrs. Cinco, made a morion to enact Ordinance No. 91-37. <br />Mr. Patrick explained this would establish an account for performance of various contractors to <br />work on the Village Trails development. <br />Mr. Pietrafese asked if anything was in there about the entranceways--who will maintain them, etc. <br />Mr. Ramos said they would be maintained by the home owner's association. <br />Mr. Hovancsek explained that the developer will be setting up a home owner's association who <br />will be in charge of the maintenance and beautif'ication of the entranceways and common azeas. As <br />they deed the lots, all lots will be part of the corporation or part of the liability. Once the Articles of <br />Incorporation are set up, filed, and locked in; everyone will be aware that they are part of the home <br />owner's association as they purchase the lot. <br />Mr. Rinker asked how we can be sure of this; should we solicit a letter of intent as to how they are <br />doing it. <br />Mr. Ramos will make a formal request of the developer. Mr. Ramos said he will review the deed <br />restrictions and bylaws and will include informarion in Council's packet on Friday. He or Mr. <br />Hovancsek will get in touch with Mr. Marino if they have any other questions. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Ordinance Enacted <br />First Reading of Ordinance No. 91-38. enritled; "An ordinance adopting new rules and regulations <br />for Stormwater Management and Urban Sediment Pollution Abatement and declaring an <br />emergency." Introduced by Mayor Carmen and Council as a Whole. <br />Mrs. Mills requested that this ordinance remain on first reading until it-is discussed by the Storm <br />Water Management committee. <br />First Readin2 of Ordinance 91-39, enritled; An ordinance granting a variance to Jeffrey R. Eadie, <br />D.D.S. for the purpose of maintaining a sign on certain property located located at 865 SOM <br />' Center Road." Introduced by Mayor Carmen and Council as a Whole.
