31
Special Council Meeting
1/24/94
Page 9
Finally, we must all recognize the few one time chances we are given to preserve and
cherish special places like the Upper Forty, and in this case, right here in Mayfield
Village. ?-_
Thank you."
?
? Mr. Fixler, seconded by Mr. Stephens, made a motion to adjourn into executive session
? to discuss pending litigation.
z ROLL CALL: AYES: All
C NAYS: None Motion Carried
G '
Council went into- Executive Session at 7:42 p.m.
Council reconvened at 8:50 p.m.
Mrs. Cinco: We're all back. I woulcf like to ask Mayor Rinker for his comments at this
time.
Mayor Rinker: First of all, let me just say in case you have observed our Law Director is
not here, he had another meeting tonight and at the outset we were aware that he was
pressed for time. We were able to consult with him beforehand, and I am going to try
to summarize a number of points; probably not very well. And, I just want to say that I
appreciate the way that you have pressed your points; you try to present them as
succinctly and directly as possible. You have certainly been heard by us, whether it
3 seems that way or not. Mrs. Peirce, I would suggest to you that we have not taken the
advice of but one engineer. We have looked to a number of engineers and other experts
as well. The initral study commissioned of Burgess and Niple was back in 1988. It did
not look simply at this drainage problem but at a number of problems, because we in
the Village are we11 aware of the facts of history that have been visited upon us. There
is not a person here that would dispute that there have been decisions of the past that
were not well made. Hindsight is 20-20. There were people back them who probably
could have foreseen some of the problems that we are now facing. Laying blame,
discussing some philosophical points about what is valuable or not, unfortunately, I
think is something we cannot address now. We have studied this very carefully. We
have engaged a number of different people of different professions to assist us in that
