25 <br />MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Mayfield Village <br />january 24,1994 <br />The Council of Mayfield Village met in regular session on Monday, January 24,1994, at <br />7:04 p.m. in the Council Chambers at the Village Hall. Council President Joanne Cinco <br />presided. <br />ROLL CALL: Present: Mr. Busa, Mrs. Cinco, Mr. Fixler, Mr. Flynn, and <br />CD Mr. Stephens <br />M <br />co Absent: Mr. Basile; Mr. Ferrante <br />z Also Present Were: Mayor Rinker, Mr. Brett, Mr. Cappello, Mr. Diemert, <br />C Mr. Hovancsek (until approx. 7:40 p.m.), Mr. Samac, <br />? and Miss Heath. <br />Mrs. Cinco asked Mr.rHovancsek and Mr. Cappello to start with a presentation of <br />Upper 40. <br />Mayor Rinker: We had initial discussion last week. In the interim, what we have tried <br />to do is to satisfy ourselves certainly that we have explored every option, at least as <br />reasonable as we feel we can. And I know that you (Steve) and Tom especially have <br />been doing a lot of work all along, but especially in the last couple of weeks. We have <br />all had a chance to view the premises and walk the land. We certainly want to have the <br />Peirces and Merkels have an opportunity to have their say tonight. Mr. Mark Mackert <br />is here from Whitehaven and I am glad that he has shown up. And anyone else who <br />has comment, I think it would be helpful first, if we would try to have our engineers lay <br />out as best as they can: 1) what it is we have to decide tonight in their estimation; and <br />why, how we have gotten to the point where we have. I think it is necessary to reiterate <br />at least the milestones of the effort that has gone on from initial studies in this area up to <br />the specific program we are dealing with tonight. <br />Mr. Hovancsek: Thank you very much, Mayor. The Master Drainage Study for <br />Mayfield Village was authorized to be done by Burgess & Niple to do in September of <br />1988. In October of 1990, there was a meeting with Metroparks concerning the Upper 40 <br />drainage problem. In October 25 of 1990, there were proposals submitted by several <br />firms to do the drainage study. On November 6,1990, the outlet study was awarded to <br />''U.R.S. Dalton Consultants. On December 17,1990, the Engineer met with U.R.S. <br />Consultants and Metroparks to discuss the study. On January 31 of 1991, the Village <br />Engineer wrote a letter to Mr. and Mrs. Merkel, Mr. Peirce, and Mr. and Mrs. Simek <br />indicating that the Village has moved forward with the drainage contracts with U.R.S. <br />Dalton to establish a storm water management utility. The Burgess and Niple has a <br />contract with the Upper 40 preliminary detention basin design, but cannot complete
