58 <br />Regular Council Meeting <br />2/21/94 <br />Page Twenty-four <br />Mr. Busa, seconded by Mr. Fixler, made a motion to enact Ordinance No. 94-11. <br />Mrs. Cinco said Council received a letter from Mr. Hovancsek requesting them to go <br />ahead with this. <br />Hovancsek explained the Village pays 20% of the cost of the project. We recently <br />received a letter from the County requesting payment. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Ordinance Enacted <br />First Reading of Ordinance No 94-12, entitled; "An emergency ordinance creating a <br />new Chapter 766, Cable Television Regulation of Basic Service Rates and Charges, <br />setting forth adoption of FCC rate regulations for enforcement by the Village. <br />Mr. Diemert explained Council does not need to suspend the rules. <br />Mr. Stephens, seconded by Mr. Basile, made a motion to enact Ordinance No. 94-12. <br />Mr. Diemert said we have elected to have reserved for the Village the right to regulate <br />rates when and if they try to change the basic cable rates, it is within our rights within <br />the Federal law to try to control those. We elected to notify the FCC and Cablevision <br />that we are going to do that. We had an obligation then within 90 days to adopt the <br />regulations that we will use in reviewing those rates when and if we choose to exercise <br />that right. One of the methods you can use is to incorporate the FCC method of <br />regulating which I have done for you by merely incorporating by reference all of the <br />FCC cable service regulations. That will give you the full right to examine them, to <br />cross-examine their rates, require hearings, require proof, require them to show you <br />their accounting and their audit record, if you so desire. It is merely a formality. It does <br />not obligate you to do anything. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Ordinance Enacted <br />Executive Session <br />Mr. Basile, seconded by Mr. Flynn, made a motion to recess into Executive Session to <br />discuss land acquisition.
