208 <br />Regular Council Meeting 7/1$/94 <br />Page Fourteen <br />Mayor Rinker said we have an Ordinance Review Committee to address a lot of this <br />kind of housekeeping-type measures. It [this ordinance] came out of committee to <br />Council. Mayor Rinker said he thinks if it is tabled, they will just be burying something <br />that will resurface. <br />Mr. Diemert explained the emergency clause does not mean emergency as Webster <br />defines it. Mr. Diemert said "emergency" is defined in Village Charter [as follows]: if <br />you put in that word [emergency] after it is adopted, after three readings (whenever <br />that might be), it goes into effect then rather than 30 days after that. It merely eliminates <br />the delay of 30 days after the final adoption. That does not mean that it limits the <br />number of readings. It still has to have three readings which the Charter requires. <br />Note: Ordinance No. 94-34 was given second reading. <br />Second Reading (and amendment) of Ordinance No. 94-35, entitled; "An emergency <br />ordinance amending portions of Section 1157.08 of the Codified Ordinances of the <br />Village of Mayfield which regulates fencing in certain zoning districts." Introduced by <br />Mayor Rinker and Council as a Whole. (First Reading 6/20/94) <br />Mrs. Cinco said the original ordinance was written for open fences not over 6'. They <br />have been asked by Planning and Zoning to amend it to 5' in height. <br />Ordinance No. 94-35 was given second reading. <br />Mrs. Cinco asked for a motion of Council to amend Ordinance No. 94-35 to 5' in height <br />from 6'. <br />Mr. Basile, seconded by Mr. Busa, made a motion to amend Ordinance No. 94-35 to <br />specify a fence height of 5' rather than 6' (as in the previous version of the legislation.) <br />ROLL CALL: AYES: Mr. Basile, Mr. Busa, Mrs. Cinco, Mr. Ferrante, Mr. Flynn <br />NAYS: Mr. Fixler Motion Carried <br />Ordinance Amended <br />Mrs. Cinco said the third reading will be given at the next Council Meeting. <br />Second Reading of Ordinance No. 94-43, entitled; "An ordinance proposing an <br />amendment to Article VII of the of the Charter of Mayfield Village pertaining to the <br />initiative and referendum matters. Introduced by Mayor Rinker and Council as a <br />Whole.
