Regular Council Meeting <br />3/15/93 <br />Page 9 <br />Mr. Basile said they have asked for this variance because they must be competitive. <br />Mayor Rinker said Mr. Novak (who was here this evening) said they have taken into <br />account the volume they anticipate with the expansion of the facility, and predict a <br />19-car variance will not be a problem. There have been a number of comments that <br />people have observed over the years that Heinen's has had more than ample space for <br />their parking. <br />Mr. Fixler said He believes the parking variance across the street was given on a term <br />basis-is that up for consideration that the basis would be on a term. <br />Mrs. Cinco said she did not think so because of the amount of money put into this <br />reconstruction, and asked the gentleman from Heinen's to comment. <br />The man in the audience said he cannot answer for Mr. Heinen but he is inclined to <br />think that a term arrangement on that variance would not be viable. <br />Mayor Rinker said one basic distinction that can be drawn is that in the other area, those <br />are rental properties. Their concern for those properties was that they not etch <br />something in stone, because if the business changed there would be a totally different <br />usage which would change the condition of the nature of the variance. <br />The man in the audience said Heinen's owns the property and the store and they intend <br />to be here for a long, long time. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Variance Granted <br />Mr. Diemert said the second matter was a side yard variance for encroachment into the <br />side yard by the divider wall on the north side of the property. They want to extend the <br />existing wall another 45 feet to S.O.M. Center Road. <br />Mr. Basile, seconded by Mr. Ferrante, made a motion to grant a side yard variance to <br />Heinen's (860 S.O.M. Center Road) for encroachment into the side yard by the divider <br />wall on the north side of the property (as stated by the Law Director above.) <br />Mayor Rinker said the church is expanding its parking lot; Heinen's has already built a <br />retaining wall along the current lot. As that parking lot is extended, Heinen's has <br />agreed to accept the responsibility of extending that retaining wall. That is a benefit to <br />the church and shows a good relationship between neighbors.
