Regular Council Meeting <br />5/17/93 <br />Page Two <br />flow in this area. The swale on the western boundary of Hanover Woods abuts our <br />properiy for approximately 460 feet. Mrs. Coyne said since the elevation of lots on <br />Hardwood was raised, this swale was to protect our property from water flowing back <br />on it. During 1991, a house was constructed at 820 Hardwood by the DeMicheles. Once <br />they moved in, they brought dirt and filled in the swale in order to extend their back <br />yard. At the time this occurred, I called Gus Amendola and notified him. He said the <br />Village was reviewing all swales and the problem would be corrected. In the meantime, <br />the DeMicheles erected a fence and planted a garden in the former swale area. <br />Mrs. Coyne said we have been patient for two years. During this time, our property has <br />been damaged by excessive water. Many of the trees we have planted in 1992 have <br />died. Half of the daffodils which used to cover this field have rotted, and the ground is <br />full of deep ruts caused by mowing the wet field. We would like to know what action <br />the Village plans to take to correct the swale violation. <br />Mayor Rinker said we are making arrangements to have a mecliation conducted. Mr. <br />Diemert will be chairing that. Any property dispute is a sensitive issue. The history <br />which Mrs. Coyne has outlined is a classic demonstration of the kinds of problems that <br />can develop. We generally try to look to all interests. He is asking them to continue to <br />be patient. Our idea is to set up a mediation. It is his understanding from talking to Mr. <br />Amendola that the DeMicheles' are also willing to sit down and see if we can work out a <br />plan that is going to be acceptable to everyone. There is no question that the matter of <br />the swale must be resolved so the.swale functions as it should. This is the responsibility <br />of the property owner and we want to make sure the obstruction is alleviated. He asked <br />them to try to maintain an open mind and approach the mediation with an idea this will <br />be resolved. Mayor Rinker said the mediation will take as long as the parties want to <br />take. It is literally sitting down in a room with Mr. Diemert as a mediator. The <br />mediator is to see if the parties can work out an arrangement between themselves <br />bearing in mind that there are certain rules and regulations that everyone must follow. <br />Rav Koren, 6900 Wilson Mills - said his property abuts Shirley's. When Hanover Woods <br />went up, the people walking around back there said they were going to have to cut a <br />swale. There was a thick forest with 30-40' high trees. They cut a path of forest out at <br />least 15' deep and 1,000 feet around and destroyed a huge number of trees. Mr. Koren <br />said he feels if it was important enough to destroy the forest for the swales, it is <br />important for the swale to be mainfained. He thinks it is ridiculous to destroy the forest <br />and then say they do not need the swale. <br />
