Special Meeting <br />6/14/93 <br />Page Five <br />Motion to Approve an Expenditure of $5,923.50 to Radio Communications Specialists, Inc. <br />(to upgrade the radios in the Service Department - Phase III) <br />Mr. Busa, seconded by Mr. Basile, made a motion to approve an expenditure of <br />$5,932.50 to Radio Communications Specialists, Inc. to upgrade the radios in the Service <br />Department (for Phase III.) <br />ROLL CALL: AYES: All <br />1VAYS: None <br />Motion Carried <br />Expenditure Authorized <br />ANY OTHER MATTER THAT MAY COME BEFORE COUNCIL <br />Mrs. Cinco said it is her understanding they do not have any need for an Executive <br />Session. <br />Mr. Diemert said the trial has been continued at least a month. They do not have a <br />definite date as yet. The Judge started a criminal trial and has to finish that. He hopes <br />to get it back on the docket for August or September. <br />Mr. Fixler said he went out to the Sullivan property and although it is a very complex <br />problem, the part that he wants to address this evening is just the open swale part. He <br />said there is a grate at the north end of the property that fills in with her neighbor's <br />water (across the street, next to--on both sides), then there is a pipe that takes this water <br />and goes down along the side of her property. For some reason the pipe ends halfway <br />down the property and turns into an open swale. Mr. Fixer said in examining that <br />water, he found it is murky, discolored and has an odor. All that he is requesting at this <br />point is that they put the additional pipe on so that water can go beyond her property-- <br />just to fill in the open swale. He thinks this is not just her problem because everyone <br />else's water drains into it. <br />Mayor Rinker said he and a number of others went out last year with the Village <br />Engineer and Building and Service Director. He said there is no question this is creating <br />a problem for them. The issue he sees now, and he has asked in a memo, is that <br />everyone try to stick with the program that he is working rather hard to implement. <br />Where the Village has clear responsibility within rights-of-way, where there is clear <br />responsibility, the Village handles those regularly. Swales are individual properiy <br />owners' responsibilities. Mayor Rinker said he receives virtually identical calls every <br />week. The fact that water passes through, over or from other people's properties onto <br />an individual property owner's lot theoretically is incidental. There are a number of <br />factors they take into consideration and they take the problems on a case-by-case basis.
