Regular Council Meeting <br />6/21/93 <br />Page Two <br />Mayor Rinker said if the Prosecutor believes that it is something that we can go in and <br />give it a little extra push, we will. In certain situations we have gone in and tried to <br />remove things and we will bill the property owner for it. Mayor Rinker said we have <br />done just about everything we feel we can do under the law. <br />Mayor Rinker explained the prosecution is that either a Judge or Jury will consider the <br />charges that brought against him and render a verdict as to what has to be done. We <br />want to have everything cleaned up and the rubbish removed. <br />A few residents in the audience invited everyone to come and look at the property from <br />their yards. <br />One of the residents commented that there was a dead skunk in the man's garage. <br />Shirley Covne, 6910 Wilson Mills, said she attended the May 17 Council Meeting and <br />brought to Council's attention a water drainage problem caused by a swale obstruction <br />at 820 Hardwood Court. She explained the problem. Ms. Coyne said at the May <br />Council Meeting, Mayor Rinker asked Mr. Diemert to schedule a meeting with the <br />homeowners. She said when they met with the Law Director on May 28, they were told <br />to dig out and taper the swale to allow water flow. The Law Director did not feel there <br />was sufficient footage to allow water to flow around the garden and thereby avoid <br />moving it. The Village was to monitor the water flow. Ms. Coyne said she is not <br />satisfied with this decision. Also, after the heavy rain several weeks ago she did not see <br />anyone from the Village monitoring the water flow. Ms. Coyne made reference to Parf <br />11 of the Mayfield Village Codified Ordinances (regarding criteria for land <br />development) and Section 13 of the Hanover Woods Covenants, Conditions and <br />Resfrictions. She said that reinforces the intent that this space is to Ue kept open. Ms. <br />Coyne said she has asked Mr. Amendola whether a fence permit was granted for 820 <br />Hardwood, but has not received an answer. Ms. Coyne said approval of the Village <br />Engineer is required before maldng any changes in land topography. She is sure the <br />home owners at 820 Hardwood did not seek his approval to fill in the swale and re- <br />grade their lot; Mr. Hovancsek's letter of September 15,1992 states that the soil and <br />other obstructions must be removed from the swale. Ms. Coyne said the intent of the <br />law seems very clear to her, and she does not understand how the Village can allow this <br />blatant violation to continue. <br />Mr. Diemert said he has gone to great extent to explain exactly to Ms. Coyne exactly <br />what happened and the patter of enforcement the Village has taken. Mr. Diemert said if <br />she did not understand it after that letter, there is nothing more he can say to make her <br />understand it. The purpose of a swale is to move water through properties.
