Council Meeting <br />6/21/93 <br />Page Six <br />revitalize it very economically; they had approval on a plan that was suitable Regular <br />temporarily, and it was shut down rather quicl<ly which he felt he should have been <br />more involved in the end result. Mr. Cardarelli said he is not an Engineer but he asked <br />to go to a meeting in the end stages and was told he was not allowed to come. He was <br />already involved in materials, etc. to get the project underway. He has received a letter <br />from the Mayor which explained everything; the only thing he felt (due to the fact he <br />has been involved with the City for a lot of years), he felt he should have been treated <br />with a little bit more respect in regards to this matter. He thinks he should have had <br />meeting face-to-face with the Mayor on this--due to the fact they did have an agreement <br />on the job that was being completed and the plug was pulled on the project. Mr. <br />Cardarelli said he is supposedly going to be compensated for the work that was done <br />but felt a little hurt that he was not more tall<ed to. <br />Mayor Rinker said he is sorry Mr. Cardarelli feels he was distastefully taken care of. <br />When Mr. Cardarelli approached hitn at a Recreation Meeting several months ago with <br />the proposal, Mayor Rinker said he thought it sounded like an excellent idea. <br />Unfortunately, as often happens when we try to work out details--it took quite some <br />time before he got any specifications from Mr. Cardarelli and it was on a date where we <br />had to act within 24 hours in order to get some fill dirt he was able to deliver. Mayor <br />Rinker said when Mr. Cardarelli presented the two-part proposal, he advised him then <br />that because his proposal (for the two parts) was $5,000.00, it was beyond his spending <br />authority and Council would have to lool< at. The first step, which he had thought <br />might be doable, was to build a levee along the east banl< of the creek, (which was Mr. <br />Cardarelli's suggestion.) He thought it was good idea if they could install it this <br />summer, with many of the different facilities the Recreation Board was looking at, it <br />would be just great. Unfortunately, we had to get an easement from the properEy <br />owner next door, Mr. Pesey. Mayor Rinl<er when he inet with Gus, Steve, and Mr. <br />Pesey, he explained the many flooding problems he has endured amd has to deal with. <br />It was at that time, the Village Engineer advised hiin that unfortunately, all we would <br />be doing would be deflecting the water from our site over onto Mr. Pesey's property. <br />He is sensitive to the fact that not very far from that spot is a certain Myotte property <br />which was a source of litigation--the Village was involved in lawsuits in the '70s. It was <br />a landmark decision under Ohio law on water control. Mayor Rinker said we would be <br />sitting ducks if we were going to mal<e the improvements that Mr. Cardarelli <br />recommended and cause damage to any adjacent properties. Because we were pressed <br />for time, I made sure that any further work (by Mr. Cardarelli) would be stopped so <br />that he would not go to unnecessary worl<. Mayor Rinker said he asked that Mr. <br />Cardarelli contact him; he knows that Mr. Cardarelli spoke to Donna Heath. Mayor <br />Rinker said it is $100,000 + to redo that entire drainage area to do it properly; he must <br />go on the recommendation on the Engineer. He feels the fill dirt will be put to good use <br />and even though we had to stop, what he has provided will be enjoyed by the residents.
