Regular Council Meeting , - <br />3/18/96 ' <br />Page 12 Mr. Samac said he is ready for them to be adopted. He said that probably, next ,. <br />month, Council will have before them several other procedural ordinance changes <br />to bring the code in line with the Charter. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried - Ordinance Enacted <br />First Reading of Ordinance No 96-11entitled; "An emergency ordinance repealing <br />Section 1149.09 relative to variances by Council." Introduced by Mayor Rinker and <br />Council as a Whole. <br />Mr. Diemert said he has attached the existing Section 1149.08 of the code as "Exhibit <br />A." In that, it sets forth how. Council can grant variances. In the past, Council <br />handled all variances originally in commercial zones and industrial districts. <br />Because of the Charter amendment by the Charter Review Commission; Council. <br />does not hear, those any longer. They go directly ta the BLA first and then they can :. <br />be reviewed by. Council if you so choose. That provision in the Codified Ordinances <br />is no longer proper since it conflicts with the Charter. ? <br />Mayor Rinker questioned the procedure for presenting it to Council. <br />Mr. Diemert said the Building Commissioner will be monitoring this closely and <br />will bring to everyone's attention. <br />Mayor Rinker requested Mr. Samac make that part of his report to Council. We <br />should set up a tickler system. Mayor Rinker said if something must go in the <br />packet, Mr. Samac should alert Donna of our need to move on this. He wants to <br />come up with a workable system to make sure we are calendaring these things <br />appropriately and flagging them so we don't miss out. - <br />Mr. Samac said he will make sure he does that. He thinks it is imperative everyone <br />understands that per the provisions of the ordinance, it is incumbent on anyone <br />(Councilperson or property owner affected) to notify--after the decision of the Board <br />of Appeals--in writing to Donna--of their intent to appeal the decision of the BZA. <br />Mayor Rinker recommended the Building Department set up the procedure with <br />Donna to make sure Council is notified. <br />Mr. Ferrante asked if Council could get a written report right after the meeting-- <br />telling them what the variances are.
