<br />Regular Council Meeting <br />3/18/96 <br />Page 11 <br />Mr. Ferrante, seconded by Mrs. Cinco, made a motion to authorize an expenditure <br />in an amount not to exceed $3,100 to B&B Appliance for the purchase of appliances <br />for the Fire Station. <br />First Reading of Ordinance No. 96-10, entitled; "An emergency ordinance amending <br />Section 1105.02 and 1113.25 of the Codified Ordinances relative to the granting of <br />variances by the Board of Zoning Appeals." Introduced by Mayor Rinker and <br />Council as a Whole. <br />Mr. Diemert said the Charter was amended in November by the voters. Since the <br />Codified Ordinances reflected the old Charter language, (which was repealed and <br />changed by the voters) Mr. Diemert said he took the new Charter language and the <br />Codified Ordinances and prepared an ordinance to modify the Codified Ordinances <br />to reflect, as close as possible, the new Charter provisions. Mr. Diemert said if the <br />Codified Ordinances were contradictory to the Charter--if the code were violated, it <br />could not be enforced since the Charter must take precedence. This [legislation] will <br />bring everything in line. Mr. Diemert the Charter Review Commission <br />recommended, and the voters approved, that although the BZA hears all variances <br />(commercial, industrial), every appeal that is granted or denied by them is <br />appealable to Council and reviewable by Council. He said for things like 10 days <br />notice within which to file this notice of appeal, we took what was the norm in <br />other communities because the Charter Review Commission did not address the " <br />time period. We created procedures so that the public would know what to do. Mr. <br />Diemert said subparagraph c was an amendment that they did make to the Charter <br />requiring notice to all property owners within 300 feet. He said that is the actual <br />language of the new Charter amendment that we all have to follow. Mr. Diemert <br />said these are procedures that he and the Building Commissioner have determined <br />that we ought to follow and we are following now. <br />Mr. Busa, seconded by Mrs. Cinco, made a motion to suspend the rules of Council <br />requiring an ordinance to be read on three separate occasions. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Rules Suspended <br />Mr. Busa, seconded by Mrs. Cinco, made a motion to enact Ordinance No. 96-10. <br />Mr. Diemert asked Mr. Samac if he is ready for these [ordinances] to be adopted.
