He has no objection
to them having a sign below the existing sign. He said this was why he asked if this is
how the sign would look.
Mr. Samac said the colors and everything else would be approved by the ARB.
Council President Fixler said the only side of any motion requesting reconsideration
would be a motion from the side of approval. If yours was a negative vote, you can not
make that motion. If there is a motion that someone would like to make for
reconsideration from the 4 members of Council that made that motion, they can make
it.
Dr. Parker made a motion to reconsider the motion. Council President Fixler seconded
the motion.
Council President Fixler asked for a roll call vote for the reconsideration of the same
vote. (That Council will reconsider the same vote.) He said Dr. Parker made it clear
that in voting the way he did he was not completely understanding we were voting on
the variance and not the aesthetics of the sign. In all fairness to Mr. Quagliata and Dr.
Parker, we will entertain that motion.
Mr. Marquardt asked if this took a simple majority or a 2/3 vote.
Council President Fixler said, a majority.
Roll Call: AYES: All
NAYS: Mr. Ferrante
Motion Carried
Prior motion rescinded
Council President Fixler asked for a motion to uphold (affirm) the decision of the Board
of Appeals re Case No. 96-4.
