Regular Council Meeting <br />4/15/96 ` Page 12 <br />Mr. Ferrante asked why Council has to vote on this--this way. VVhy can't we ask them <br />for another proposal? <br />Council President Fixler said we can and they can come back. The point is if this was <br />approved to uphold the decision, they can still say they would lilce to modify it and <br />come back to us. <br />Mr. Diemert said a motion to affirm the decision of the BZA would be a denial of the <br />variance. If Council wants to reverse the decision of the BZA and grant the application, <br />it would be a motion to reverse the decision and grant the application. Then, there is <br />the option of modifying and making the motion that the denial be modified and they <br />be granted a variance to approve Spaghetti Company without changing the fascia of the <br />sign. In other words, he said, Council might not even object to tvvo separate signs--one <br />for Holiday Inn and one for Spaghetti Company provided they have the same amount <br />of fascia. <br />Mr. Diemert said the vote of the Board of Appeals was 2-2. <br />Council President Fixler said he would rather consider the first two decisions since we <br />don't know if they want to modify. (We don't have to discuss this now.) <br />Mr. Busa asked about making the motion to modify. <br />Council President Fixler said we are going to do the motions in this order: a motion to <br />affirm, a motion for denial; and if Mr. Busa would like to make a motion to modify, <br />that is his prerogative. <br />Mr. Marquardt, seconded by Mr. Ferrante, made a motion to affirm the decision of the <br />Board of Appeals (to deny the variance.) <br />Roll Call: AYES: Mr. Ferrante, Mr. Fixler, Mr. Marquardt, Dr. Parker <br />NAYS: Mr. Buckholtz, 1VIr. Busa, Mrs. Cinco <br />Motion Carried <br />The decision of the Board of Appeals (to deny the variance) stancls. <br />Mr. Buckholtz and Mr. Fixler suggested Mr. Samac send them a letter suggesting they <br />reapply (with a modification.) <br />Mrs. Cinco said all they are askin.g for is a variance. They are not asking for ARB to <br />approve that sign.
