Regular Council Meeting 4/15/96 ` Page 12 Mr. Ferrante asked why Council has to vote on this--this way. VVhy can't we ask them for another proposal? Council President Fixler said we can and they can come back. The point is if this was approved to uphold the decision, they can still say they would lilce to modify it and come back to us. Mr. Diemert said a motion to affirm the decision of the BZA would be a denial of the variance. If Council wants to reverse the decision of the BZA and grant the application, it would be a motion to reverse the decision and grant the application. Then, there is the option of modifying and making the motion that the denial be modified and they be granted a variance to approve Spaghetti Company without changing the fascia of the sign. In other words, he said, Council might not even object to tvvo separate signs--one for Holiday Inn and one for Spaghetti Company provided they have the same amount of fascia. Mr. Diemert said the vote of the Board of Appeals was 2-2. Council President Fixler said he would rather consider the first two decisions since we don't know if they want to modify. (We don't have to discuss this now.) Mr. Busa asked about making the motion to modify. Council President Fixler said we are going to do the motions in this order: a motion to affirm, a motion for denial; and if Mr. Busa would like to make a motion to modify, that is his prerogative. Mr. Marquardt, seconded by Mr. Ferrante, made a motion to affirm the decision of the Board of Appeals (to deny the variance.) Roll Call: AYES: Mr. Ferrante, Mr. Fixler, Mr. Marquardt, Dr. Parker NAYS: Mr. Buckholtz, 1VIr. Busa, Mrs. Cinco Motion Carried The decision of the Board of Appeals (to deny the variance) stancls. Mr. Buckholtz and Mr. Fixler suggested Mr. Samac send them a letter suggesting they reapply (with a modification.) Mrs. Cinco said all they are askin.g for is a variance. They are not asking for ARB to approve that sign.
