10 <br />Regular Council Meeting <br />7/1/96 <br />Page 9 <br /> <br /> <br />Council President Fixler said they are not asking for anything specific that does not adhere to our <br />code. They want approval to work something up. The question should be: as long as they <br />adhere to our code and zoning of Mayfield- Village, can they go forward. The answer clearly <br />should be--they are not asking for a variance--we have an obligation to say go ahead and develop <br />the concept and we will take a look at it. <br />Mr. Buckholtz said they are property owners; they are following the code and it is time <br />consuming and expensive to develop this property. It is quite possible that stormwater <br />inanagement can be helped by this. He thinks Mr. Busa might be afraid of the "runaway freight <br />train effect"--if we start approving things, a little further down the road, the next time we are <br />voting on sometTiing we are told we voted on this months ago--what's the hang-up here. He <br />thinks it is very important the minutes what Mr. Diemert said a few minutes ago--that conceptual <br />approval is not binding in any way. <br />Roll Call: AYES: Mr. Buckholtz, Mrs. Cinco, Mr. Ferrante, Mr. Fixler, <br />Mr. Marquardt and Dr. Parker <br />NAYS: Mr. Busa <br />Motion Carried <br />Conceptual Approval Granted <br />A Motion to AMrove a New Commercial Special Use Pernut for Planet Baseball at 651 Beta <br />Drive <br />Mr. Ferrante said Planning & Zoning voted yes on this proposal contingent upon their having <br />enough parking and also that it would revert back from the special use to the original use if they <br />decided to move out. <br />Mayor Rinker said the people from Planet Baseball showed us the concept of the building they <br />would be constructing. It looks like an office building; it is like a racquet club for baseball. They <br />will have 3 full time and a few part-time employees. It is not a retail use. There were a lot of <br />questions about traffic flow. The design includes 7,500 square feet to be used as an office on the <br />second floor. Mayor Rinker said they got a l,nanimous straw vote tha.t P&Z would recommend <br />Council go forward with it. <br />Council President Fiyder said he would like representatives from Planet Baseball to make a <br />presentation to Council so they can see conceptually what we are looking at. This item will be <br />placed on the August agenda. <br />Mr. Samac said he will contact them.
