9 <br />Regular Council Meeting <br />7/1/96 <br />Page 8 <br />Council President Fbder asked the Law Director how binding a conceptual agreement is. <br />Mr. Diemert said it is not [binding] at all. It just gives an idea as to whether it is an acceptable use <br />or not. ' <br />Mr. Hovancsek said there are two significant factors for site development: the Wetland <br />Delineation Report which will ha.ve to go to the Corps of Engineers and thPre axe flood plains <br />through there. <br />Discussion was held about the drainage course, the drainage basin and the two outlets. <br />Council President Fixler (addressing Mr. Bader and Mr. Goldberg) said yoax are conforming to the <br />way the code is. If you are looking for conceptual approval, a situation which is not binding, he <br />thinks that would be forthcoming--to be voted on tonight. <br />Mr. Busa expressed concern about the drainage problem on Hickory Hill. <br />Mr. Bader said he thinks from preliminary conversations we have had, from the requirements that <br />will be imposed upon the development, they will actually help reduce some of the flooding there. <br />We will be maintaining or detauung the stormwater much more than it is right now. <br />Council President Fixler said they will be voting on conception only. We will have ample time to <br />look at these situations more. They are in a conforming fashion with our current zoning. Council <br />President Fixler asked for a motion to approve the concept of the Goldberg/Sunrise Land <br />Development as illustrated on the plans we were provided this evening. <br />Mr. Ferrante, seconded by Mr. Marquardt, made a motion to approve the concept of the <br />Goldberg/Sunrise Land Development as illustrated on the plans Council were provided this <br />evemng. <br />Council President Fixler asked if there was any other discussion. <br />Mr. Busa said there are so many unknowns. We are not ready to decide anything (even <br />preliminary.) <br />
