Regular Council Meeting <br />5-17-99 <br />Page 5 <br />Mr. Schultz said they told him at Lawyer's Tifle it was constitutional. <br />Mr. Diemert said the deed restrictions are constitutional but we must treat people equally in the <br />Village. He said if there was anything he could do to help, Mr. Basile should call his office. <br />Mr. Schultz said to put an abeyance on it for a couple of weeks. <br />Mr. Diemert said he didn't think it would be possible to do for a couple of weeks but asked Mr. <br />Samac if it was possible to do it for a few days. <br />Mayor Rinker asked if they have had any discussion with the individual seeking to build the <br />structure or if they have any inclination to do so. <br />Mr. Schultz said no. <br />Mr. Samac said shortly after he received the copy from Sandy Basile he contacted the <br />homeowners proposing the addition and thoroughly informed them of the requirement and asked <br />him to check his own deed and informed him that according to my eonversation with Mr. Basile <br />that there may be a possibility of some action being taken with regard to the restrictions but it <br />-would have to come from Mr. Basile or the homeowner's association. <br />Mayor Rinker said it might be good to have his attorney talk with the Law Director to make sure <br />that both sides are apprised. <br />Mr. Diemert said he would like to explain this to hixn before he starts ripping off his roof. <br />Darlene Dietke. 6791 Wilson Mills Road, said she and a few neighbors and some children are <br />here. Traffic on Wilson Mills is getting busier and she knows the police enforce it but the speed <br />is always creeping up. From Rt. 91 to Kenwood there are 9-children. She asked the small <br />children to come up before Council. She said they would like to start a project of getting a <br />sidewalk on our side. Ms. Dietke said her friend was turning into her driveway and was rammed <br />from the back and somebody behind rammed them. There is a major problem of speed on 91. <br />These kids-have no way to cross. The traffic is going so fast and traffic is increasing. <br />Sometimes she waits 10 minutes to cross to get to the bike path during rush hour. She asked <br />what they need to do to get a sidewalk on their side. It is downright dangerous. In September <br />1997 there was a young man who got killed on Wilson Mills during rush hour. The_parents on <br />Wilson Mills fear for their children. Especially going east on Wilson Mills. She is asking the <br />Village to look into this. There is no way for them to get their children to the pool unless they <br />take them by car. They can't cross the street during any hours because of the speed and increase <br />in traffic. When Progressive gets all those people in the building, we know there will be more <br />traffic on Wilson Mills--we know there is more traffic coming. She asked Council what they can <br />do to get a sidewalk on their side so they can let their kids start biking and walking to the corner <br />and to the pool and not fear for their safety. Where do we need to start?
