325 <br />? <br />? <br />(D <br />m <br />M <br />? <br />z <br />? <br />? <br /> <br />MINUTES OF A SPECIAL COUNCIL MEETING <br />AUGUST 28, 1995 <br />8:00 p.m. <br />The Council of Mayfield Village met in special session on August 28, 1995, at <br />8:05 p.m. in the Council Chambers at Village Hall. Council President Mark Fixler <br />presided. <br />ROLL CALL: Present: Mr. Basile, Mr. Buckholtz, Mr. Busa, Mrs. Cinco, <br />Mr. Ferrante, Mr. Fixler and Mr. Flynn <br />Absent: None <br />Also Present: Mayor Rinker, Mr. Brett, Mr. Cappello, Mr. Hanculak, <br />Chief Mohr and Miss Heath <br />First Reading of Ordinance No. 95-57, entitled; "An ordinance proposing an <br />amendment to Article XI of the Charter of Mayfield Village pertaining to the Charter <br />Review Commission." Introduced by Council as a Whole. <br />Mr. Ferrante, seconded by Mr. Basile, made a motion to suspend the rules of Council <br />requiring an ordinance to be read on three separate occasions. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Ferrante, seconded by Mr. Basile, made a motion to enact Ordinance No. 95-57. <br />Mayor Rinker said we need to confirm something and since we have Charter Review <br />members here this evening, we will ask for their input. Mayor Rinker explained that <br />language which had been used in Article XI as the model, unfortunately, included old <br />Charter language prior to the last amendment. He read Article XI as it reads currently, <br />"In January, 1995, and each five years thereafter, the Mayor and each member of <br />Council shall appoint one elector each (for a total of 8), who shall be electors of the <br />Municipality...." Mayor Rinker said if you look at the copies we are working off of, it <br />starts out, "In January 1995, and each five years thereafter, the Mayor shall appoint, <br />subject to confirmation by a majority vote of Council, five electors of the <br />municipality...." Mayor Rinker said this was not discussed and asked if it was the <br />Commission's intention to change the legislation. <br />Several Charter Review Commission members in the audience agreed the section of <br />the legislation Mayor Rinker was referring to was incorrect.
