326 <br />Special Council Meeting <br />8/28/95 <br />Page 2 <br />Mayor Rinker clarified we are not incorporating the language he read second--he wants <br />everyone to understand we are sticking with what he initially read which is the total of <br />8 appointed by the Mayor and each Council member, so there is no substantive change <br />to Article XI. The next portion, which was subject to discussion at the workshop, said <br />"... shall have a review session with the NYayor and Council and then recommend to <br />the voters [not to Council] such amendments, if any, to this Charter, as in its judgment <br />are desirable. (It deletes the two thirds vote of the members) but says, "The Council <br />shall [it is a direction to Council] to the electors not later than the next succeeding <br />general election any such proposed amendments." Mayor Rinker said it goes on, "A <br />complete text of all proposed amendments submitted to the electors shall be delivered <br />to the residents of the Village. However, random failure of such delivery will not <br />cause invalidation of any amendment by the voters." It was the desire of the <br />Commission to make sure that the full text for any of these changes would be mailed <br />out to voters so that they have the benefit of review ahead of time. He said we want to <br />be sure the focus of the language is not dealing with the manner of appointment of the <br />Commission members, it was really the manner in which Council would interact with <br />the Commission and there was a direction that this would be submitted to voters. <br />Miss Heath asked if a motion to amend the ordinance was necessary. <br />Council President Fixler stated he does not think they do since it was just an error and <br />not a situation of actually changing it. It was already on the record of the last Charter <br />Review. <br />Mayor Rinker said the Clerk of Council, who is also serving as Clerk of the <br />Commission, will make sure that clerical mistake is addressed. <br />Miss Heath confirmed that she and Mr. Hanculak will let Mr. Diemert know [to correct <br />the legislation.] <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Ordinance Enacted <br />First Reading of Ordinance No. 95-58 entitled; "An ordinance proposing an <br />amendment to Article III, Section 4 of the Charter of Mayfield Village pertaining to <br />Council qualifications." Introduced by Council as a Whole. <br />Mr. Basile, seconded by Mr. Ferrante, made a motion to suspend the rules of Council <br />requiring an ordinance to be read on three separate occasions. <br />I ' <br />? <br />? <br />
