Special Council Meeting <br />3-9-98 <br />Page 5 <br />Dr. Parker said he thinks they will only have one building done by tfiat time. I-ie read in the <br />document that 1'rogressave intends to construct one or more office buildings-it doesn't sa.y 5 or <br />more like it shows on the plan. That gives them the opportunity to build one building and stop: <br />Council President Fiyder said from the point of view of economy of scale, if they were going to <br />build one building, it would be very foolish on their part not to finish the project. In his opinion, <br />they have 2 choices-if you make the determination that you a.re going to build, then you build. <br />Once you decide to pull out and cut your losses, then you do that. With one building, they would <br />never be able to bear the cost of the property, the building and the money they gave to us. You <br />would not spend 4 million dollars on a piece of property to put up one building. On the other <br />hand, as you start construction you may say you ha.ve changed your mind and sell the property. <br />That could happen. But, in all likelihood, once they have given us the one million dollars, they <br />have too much into it. Council President Fixler referenced page one of the memo Council <br />received in their packet on Friday. He cornpared paragraph 2 to the 2°d last paragraph on page 3. <br />They are not asking for it to go to White Road. <br />Discussion was held. <br />Mayor Rinker said if we write in there that we make a reasonable effort, he thinks that gives a <br />kind of flexibility. The most we can pledge to do is to achieve substantia.l compliance. He can <br />see modifying the language to tie it into reasona.ble factors. We don't want one side or the other <br />to tFy to leverage this deal. If someone were to tell us that December 1998 is not realistic and we <br />should target someplace beyond that, we need to nail that down. <br />Mr. Cappetlo said he would not think it would be a problem to get the road off of S.O.M. done <br />by that time, but to service them with water or sanitary sewer ma.y be. <br />Mr. Regan (CAC member, in the audience) said if that eorporation includes in the contract that <br />they will build 5 buildings on a certain site, they will have contingent liability. They will have to <br />put that in their I Ok and it will impact their financial statement. <br />Mayor Rinker said_ he ma.y question the one versus the two. All our discussions were with the <br />understanding that they would have 2 buildings and 600 employees within the first year. <br />Discussion was held. <br />Ik. Parker said in terms of the roadway cut, he would like to-see this added in the last paragraph: <br />"that the portion of the road needed for access to this developmentfrom S.O.M. Center Road be <br />developed no Iater than.... " <br />Council President Fixler agreed. <br />Mr. Marquardt said the number of people using the pool was a poixrt of discussion. He thinks <br />Mr. Ghokel is coming back vvith another position after this had been negotiated.
