Special Council Meeting <br />3-9-98 <br />Page 4 <br />be part of it. He knows when he gets burned. The first time is bad, the second time is worse and <br />the third time he can't take it. He does not want to get involved. He is not in favor of the original <br />plan but wants to be a team player. Mr. Busa said he is not in favor of any of this and he wants <br />the minutes to reflect this. Mr. Busa said on occasions, his comments do not even appear in the <br />minutes. Before and after his comments, there are all kinds of minutes. Everyone has comments <br />in the minutes, but his do not even appear. Mr. Busa said he thinks the minutes are censored. He <br />censored them for 4 years. He would like everything he says reported. <br />Mr. Marquardt.said he thinks it begs the question, "or wha.t?" Kiss the one million dollars for the <br />pool goodbye? There is nothing that puts a condition on what happens if we don't [complete the <br />road] by December 31St for whatever reason. Since it is unbounded, he guesses it means the deal <br />is off. <br />Mayor Rinker said his feeling is they want to get them building. To answer Steve's eornment <br />about what leverage we have, once they start investing heavily into that site, where are they <br />going to go? Will they just stop and go somewhere else? <br />Mr. Marquardt said he is not disagreeing but he sees the opportunity for them to say, "you didn't <br />make December 31S" so you won't get your million dollars for the pool. " <br />Council President Fixler said it has happened that people don't get what they want and abandon a <br />site. <br />Mayor Rinker said he suggests we write the language to reflect that we will put forth a good faith <br />efFort to have the road done by December, 1998. If the verbiage is such that there is that kind of <br />flex in there, if we end up going 3, 4, or 5 months over because of circumstances beyond our <br />control, but those aren't used arbitrarily against us. <br />Mr. Cappello asked if they were tallcing about the portion off of S.O.M. and all the way to White <br />Road? <br />Mayor Rinker said he thinks it is just to get ingress and egress off of S.O.M. to service their site. <br />To the extent that Progressive plans to have its facility operational (they have to be able to put <br />600 employees in there for certain monies to come through.) <br />Dr. Parker asked why they need a second outlet so fast. <br />Mayor Rinker said there is mutual incentive for both sides to work in a cooperative way. This <br />plan is designed to work in that way. We need to say they have raised the point, this is the <br />language we want in there so they don't come back to squelch this deal; we want everything to <br />work out well.
