He asked <br />that legislation be prepa.red for Perk Co. with the conditions put in and the understanding that <br />prior to the I 80' the dollar amount could- be changed. We are making Eouncit aware that this is <br />the preliminary recommendation and noting some pitfails we are anticipating. <br />Mayor Rinker asked the vote tonight incorporate this entire letter by reference into the vote. It is <br />a contingent vote and before any contract is let, there will have been written confirmation of <br />these line item issues so we are secured on them: (A copy of the letter will be attached to the <br />minutes as a permanent record.) <br />Mr. Marquardt asked if Council is voting to allow them to negotiate. <br />Mr. Brett said they are voting on the recommendations of the engineer. The engineer is <br />recommending Perk Company with these things you should be aware of. If these things aren't <br />rectified, we wtli recammend next on the list. He wants them to be aware of the price and <br />contingencies now. They woiild be voting xo accept the recommendations of the engineer and <br />give contingent approval. <br />Mr. Diemert said the conYract could be awarded tonigh# by motion if Council wished. <br />Mayor Rinker asked if we would be deiaying anything by waiting for a formal vote. <br />Mr. Brett said no. <br />Dr. Parker asked why there was such a huge swing on some of the items. <br />Mr. Hovancsek explained it is strictly business, eash flow. Some prefer to put their profits in at <br />the baginning of the job. <br />Coizncil President Fixler asked for a motion to proceed with legislation for Perk-Company for the <br />access road for the North Chagrin Commons if a tentative vote is needed tonight. <br />Dr. P4rker, seconded by 1VIrs. Cinco, made a mozion to proceed with legislation for Ferk <br />Company to accept the bid for the access road with. the recommendations of URS Greiner as set <br />forth in their correspondence and documentation of May 4, 1998. [The carrespondence from <br />LTRS Greiner will be attached to the minutes as a permanent record.] <br />Roll Gall: AYES: All <br />NAYS: None <br />Motion Carried <br />The Law Director is authorized to prepare legislation.
