Special Council Meeting <br />8-24-98 <br />Page 9 <br />Mayor Rinker said we don't want to force the issue. He can't say she won't receive <br />anymore letters. <br />Mrs. Moyer said that is the way they all feel on White Road. We feel safe there, are <br />happy there and are good neighbors. They are good to the Village. <br />Mayor Rinker said when change comes into an area, all of a sudden you get people <br />knocking on your door. <br />Mrs. Moyer said she has not had anyone approach her. It was hearsay. She asked if this <br />was going to be for apartments. <br />Mr. Masevice said he and other neighbors have never been approached by anyone. The <br />first offer he had was from the Village. <br />Mr. Considine asked if the Village attorney was here tonight. <br />Mayor Rinker said he was not. <br />Mr. Marquardt said when he spoke to him, he said he hadn't sent out any letter regarding <br />eminent domain except to the two on Midvale. <br />Mr. Marquardt said he had asked Mr. Diemert to read the letter and the letter states that if <br />the offer is not acceptable, the Village will likely exercise eminent domain. He thinks <br />that must be reviewed. <br />Mayor Rinker agreed. He addressed Mrs. Moyer and said the Law Director explained her <br />rights in the letter and he is sorry it.was couched in those terms. <br />Mr. Considine said he is curious if Council and Mayor Rinker are planning to follow up <br />and go through with the eminent domain--as indicated in Mrs. Moyer's letter. <br />Mayor Rinker said right now, we are not planning on pursuing eminent domain. There <br />has been no resolution of intent. This Council would have to vote to pursue it. He can't <br />say the threat means nothing. We intend to initiate discussions with those property <br />owners who would be inclined to discuss this with us. One of our concerns is that there <br />are other entities/individuals that might be interested. <br />Mr. Masevice wants to make sure they are brought into the plans as the Village is <br />thinking about them. He does not want to be left out of the loop. He hopes it is a fair <br />arms length negotiation. When he hears "will execute"--that is low balling. <br />Mayor Rinker said by law, we have to deal fair market value. There are a number of <br />people out there who will have different points of view as to what fair market value <br />
