MINUTES OF A SPECIAL MEETING OF COUNCIL AS BOARD OF APPEALS
Mayfield Village
September 14, 1998
The Council of Mayfield Village met in special session as a Board of Appeals on Monday,
September 14, 1998, at 8:00 p.m. in the Mayfield Village Senior Center/Community Room.
Council President Mark Fixler presided.
ROLL CALL: Present: Mr. Buckholtz, Mr. Busa, Mrs. Cinco, Mr. Fixler,
Mr. Marquardt, Mrs. Mills and Dr. Parker
Absent: None
Also Present: Mayor Rinker, Mr. Brett, Mr. Metzung, Chief Stevens and
Mrs. Roman
Council President Fixler said Council had received a packet regarding Mr. Sandler's request
(regarding his shed at 6739 Eastgate Drive.)
Mr. Samac said he had informed Mr. Sandler of the date and time of this meeting; he indicated
he would be attending but he is not in the audience.
Council agreed to convene the Special Council Meeting first. Council President Fixler said they
will come back to this item.
Council reconvened the Board of Appeals meeting following the Special Meeting at 9:30 p.m.
Council President Fixler asked if Mr. Sandler wanted to further explain his request to Council.
Mr. Sandler said he built one corner of the shed himself. Maybe he misunderstood the article in
the Village magazine that said if you hired a contractor, you had to get a permit. Since he built
the shed himself he was not thinking about the problem. He asked his neighbors about it and
they had no problem with it--they even signed a waiver. He has started the landscaping as
promised. Mr. Sandler showed several pictures to Council.
Council President Fixler asked Mr. Samac if he had any additional information to add.
Mr. Samac said he thought Mr. Sandler had covered everything. The variance being requested is
fora 2' variance of the side property line.
Council President Fixler said typically speaking when a variance is granted by Council, it is
primarily because of a hardship. He asked Mr. Samac if there would have been any other way of
placing the shed in the general location--or if there are other areas available on his property for
this shed (that wouldn't require a variance.)
Mr. Samac said there are certainly other areas available on this property for the shed. If the shed
were moved 2' to the south it would conform to our co,
