Special Council Meeting <br />9-21-99 <br />Page 5 <br /> <br />1 <br /> <br />Mr. VanVliet said to change it from residential would take a vote of the people. <br />Mayor Rinker -and Mr. Diemert said or a court order. <br />Mr. VanVliet asked if that wasn't enough assurance that it would stay as it is. <br />Mayor Rinker said it absolutely is not. Avery convincing argument could be made that it should <br />be developed. <br />Mr. VanVliet said what about the historic significance of the building. <br />Mayor Rinker said what we have seen from two very capable appraisers in this community, that <br />it has no significance in the marketplace. <br />A member of the audience asked because of the building or the property. <br />Mayor Rinker said he guesses both. <br />A member said she thinks the property itself would be historic. <br />Mayor Rinker said he does not know if that is true or not. It has to be characterized as such. If it <br />is not on the Register of Historic Places, he does not know what it takes. <br />Members of the audience said the building had burned and was rebuilt in the 1940's. <br />Mayor Rinker said he would venture to say that its historic value is something that is very real to, <br />each of you and to a lot of people in this community. `1Vhat the law recognizes as historic value, <br />he suggests is a very different thing. That does not mean it could not be established as such. <br />But, right now that isn't the situation. And right now, we feel if this were a matter that were put <br />to a Court test, it could be a serious issue and we are treating it seriously. <br />Council President Marquardt requested a motion from Council to recess into Executive Session <br />to discuss real estate matters. <br />Mrs. Mills, seconded by Mr. Ilacqua, made a motion to recess into Executive Session to discuss <br />real estate matters. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Council went into Executive Session~at 8:12 p.m. <br />Council reconvened at 9:15 p.m. <br />
