104 <br />Mr. Busa asked if it would please Council and the residents present if Council <br />appointed three members of Council and Beechers Brook residents appointed three <br />members who would discuss this matter with our Engineer and Law Director and <br />work out a solution, then bring it to Council for a final decision. <br />Council did not agree as it might prolong the issue. <br />Mr. Feneli said in his opinion it is in the best interest of the Village that <br />this road be paved in accordance with the recommendation of the Village Engineer, <br />that the road be dedicated to public use and public maintenance and be done with <br />this private roadway once and for all. <br />Mr. Flynn asked what the ramif ications would be if the road were a private road <br />since Mr. Feneli was warning Council of possible problems. <br />Mr. Feneli said there would be problems because if we do not assimilate the <br />roadway into the public roadway system in the municipality, and allow it to <br />remain as a private road when it is an access road abutted on both ends by <br />dedicated roads. If the road deteriorates the Village cannot force the <br />residents to fix a private roadway. <br />Mrs. Hanus said the res.idents want the road to remain private, they will put <br />in a new road that will be acceptable for use and will ma.intain it each year. <br />She said if the residents are agreeable to this, Council should proceed that way. <br />Mr. Feneli said new homeowners may not want to keep the agreement and the <br />Village cannot force them to maintain the road. <br />Mrs. Bloom questioned the possibility of an agreement between the residents <br />of the street and the Village that would apply to new residents who may move in. <br />Mr. Feneli said he did not know of any way that could be done unless it could <br />be somehow attached to the property deed. <br />Mr. Reiber asked Council to vote on the matter. <br />Mr. Busa said Council cannot ma.ke a decision now without all the facts, there <br />are still debateable issues. He suggests a small committee,be formed to <br />resolve this and will call a Special Meeting next Monday. <br />Mr. Feneli will meet with a small committee to go over everything he.has. <br />Mr. Hovancsek and Mr. Stankus will also meet to discuss the project. <br />Mr. Etzler asked if there were curb drains planned for the proposed road. <br />Mr. Reiber said there were no curbs planned but there is drainage at the edge of <br />the road. <br />Mr. Etzler said it seems some changes in the plans were made since Mr. Hovancsek <br />talked to Mr. Stankus. <br />Mr. Etzler asked what the difference in cost is between Mr. Hovancseks proposed <br />road and the Beechers Brook contractors price.
