115 <br />- 2. He wants the Beechers Brook residents to know he feels they are <br />making a grave error. They will be faced-with.many problems in the future <br />when the road starts to deteriorate. Will they be as willing to spend money <br />for repair at that time? He does not feel the road the residents are <br />proposing will last as long as the road originally proposed by the Village <br />Engineer, which would have resolved all problems with no questions. <br />He does not think the Village wants to get into a dispute with tlie property <br />owners over this issue after weighing all equities involved, including the <br />threat of litigation. If the Village Engineer will accept,the road as they <br />propose for people to drive on, as a private road, not to be accepted by the <br />Village, that would satisfy him. This is an action being taken by Council, <br />not as a concession that it is a private road. We cannot bind future Councils <br />and they may decide-_differently. <br />A resident comment;ed.he feel.s it would.be wise for..the residents to meet <br />annually with the Village representatives to.discuss the status of the road, <br />and what repairs should be made. He agrees a small escrow fund, of perhaps <br />$50.00 per family each year would be a good idea. This would remind the <br />residents of their responsibility. The majority must agree to this before a <br />final decision can be made. Mr. Busa concurred with the idea of conferences but pointed out they should <br />be arranged first through the Mayo'r. <br />Mrs. Bloom feels a contract is needed so we have in writing how much each <br />property owner is to add to the escrow account so there are no questions in <br />the future. - <br />Mr. Etzler asked Mr. Hovancseic to estimate the annual maintenance.cost for <br />the road. Mr. Hovancsek said he f elt the minimum annual cost per property owner to be <br />placed in an.escrow fund would be $50v00 or $100000 maximum. • Repairs should <br />not be necessary for a few years and if at that time they determine the amount <br />should be higher they can raise it. <br />Mr. Busa said Council is to make a decision tonight and feels the escrow <br />fund contract could be resolved later. He asked Council to recess into <br />Executive Session to make a decision. <br />Council went into Executive Session_ at 7:45 p.m. <br />Council reconvened at 8:00 p.m. <br />Mr. Carmen said Council has discussed this and has come up with what they <br />hope is the best solution for all concerned. <br />Mr. Carmen, seconded by Mrs. Hanus, made a motion that the residents of <br />Beechers Brook be allowed to pave their own road subj'ect to the execution <br />of an agreement with two conditions:
