It follows, therefore, that a board of town- <br />ship trustees may not lawfully pay the premium on a policy of public <br />liability insurance covering cemeteries or fire stations. <br />Since a board of townsliip trustees is liable in its official capacity <br />for damages resultiiig from negligeiice in tlie construction, maintenance <br />aiid repair of township roads, it follows that the towilship trustees may <br />lawfully pay the premium on a policy of public ]iability itisurance covering <br />such roads. <br />Accordingly; it is my opinion and you are advised that the statutory <br />]ialii]ity of Sb011'(1 of township trustees uncler Section 5571.10, Pevised <br />Code, is limited to roads, road machitiery, or equiprnent used wi[li rela- <br />tion to roads, and does not eztend to cemeteries or fire stations; thus, <br />such a board is without authority to procure liability insurance ivith respect <br />? to its cetneteries and fire stations, but may obtain such insuraiice with <br />a regard to its roads. <br />Respectfully, <br />MARK MCELROY <br />Attorney General <br />3201 <br />,i. <br />I I ?
