Elmer Spencer, Prosecuting Attorney <br />Adams County, West Union, Ohio -- <br />Dear Sir : <br />I am in receipt of your request for my opiiiion in whicli you aslc <br />'i n•hether a board of cotmty conunissioners may contract with a village for <br />?. the use of county equipment and ]abor to construct, improve, or repair <br />` villagc streets, no material to be furnished by the county. I have also <br />? received a request from another county asl:ing a similar question Nvith the <br />added provision that the county will be paid on an actual hourly cost basis <br />?for the use of county equiprnent and labor. <br />Section 307.15, Revised Code, provides, in part, as follows : <br />Y- "The board of county commissioners may enter into an <br />agreement with the legislntive nutharity of nny nrunicirnl corro- <br />?ration, tOWI1Sll1p, port autliority, water or sewer district, school <br />district, library district, hcalth district, parl: district, soil con- <br />servation district, water conservanc_y district, or otlier taxing <br />'district, or with the board of any other county, and such ]egisla- <br />? tive authorities may enter into agreements «-ith the board, wherehy <br />? such board undertal:es, and is authorized by the contracting sub- <br />? division, to exercise any poiver, perform any ft:nction, or render <br />' any service, in Uehalf of the contracting subdicision or its ]egis- <br />! lative authorit}?, ??-liich sttcli stibclivisioii or legislative atrthorit}• <br />may exercise, perform, or render. <br />(Empllasis added) <br />L'nder Section 307.15, supra;, a Uoard of county comtnissioiiers may, <br />pursuant to a contract with the legislative authorit}- of :lil\' Illlli]IC1I)al cor- <br />poration, perform any functiou .N•hidi the ]e?islati?•e <uithorit}• ma,• pcr- <br />form.
