As to the hourly cost basis, such 'would appear
to be a reasonable metliod for COllli)e11s1t111a the county for tlle furnishing
of sucli equipmecit and labor.
It is uiy opinion, therefore, and you are accordingly advised that wider
Section 307.15, Revised Code, a li011'(1 OF COlllltY COI17I111SSIO11eCS I11SY CIICZI'
i agreement Nvitli the legislativc attthority of a village providing for
of county equipment and laLor to construct, imprut•e, and repair the
st ets ivithin such village, necessary materials to be furnished by the
x•illage; and the coiitract may provide that the county will be reimbursed
on an actual hourly cost basis for the use of said equipmeiit and labor.
Respectfully,
MARK AICFLROY
Attorney General
3202
A PART-TI3IE POLICEVIAN IS NOT INCLUDED WITHIN THE
DEFINITIO\T OT "ME'MBER OF THE POLICE DEPARTMENT"
SLT FORTH IN SECTION 741.31, R.C., AND CANNOT BE A
biE,l-1BER OF THE POLICE RELIEF AND PENSION FUND.
§741.31, R.C., OPINION 4609, OAG, 1954 OPINION 1737, OAG, 1948,
54631-3, G.C., AMENDED H.B. 325, 98TH G.A. 1230.2., 345, §741.35,
R.C.
SYLLABUS:
- A part-time policeinan duly employed by a municipality is not included within"the
, ,4tion of "member of tlie police department" as set forth in Section 741.31, Re-
Eale, and has not been so inducled since said section was amended in 1949 by.
?Sth General Assembly, 123 Ohio Laws 345 ; and as a result thereof, suclr part-
Ji;5,r2 policemen may not become members of a police relief and pension fund es-
tablisiied pnrsuant to Section 741.31, et scq., Revised Code.
