121 <br />"We the undersigned agree to: <br />1. Establish an Escrow Fund for the maintenance of the original <br />section of Beecher's Brook Road. Each property owner shall <br />contribute 50(,I/frontage foot to be paid by August 31, 1984 <br />but in no event shall there be less than $500.00 in said <br />Escrow Account. Therefore, the property owner shall pay <br />this amount by August 31 subject to a majority vote taken <br />yearly. The expenditure of funds in the Escrow Account for <br />road.related repairs and improvements will also be subject <br />to agreement by majority vote taken yearly, or more often as <br />needed. <br />2. Absolve Mayf ield Village of liability for accidental damage <br />to said road caused by Village employees and equipment.in <br />the performance of Village duties." <br />Mr. Carmen, seconded by Mrs. Bloom, made a motion to amend the motion made on <br />July 25 to; a) authorize them to pave the road pursuant to our new agreement, <br />and.b) allow them to get their Building Permit tomorrow. <br />Mr. Busa asked if there was any discussion. <br />There was none. <br />Roll Call: AYES: All <br />NAYS: None <br />Motion Carried <br />Motion Amended <br />Mr: Busa asked if there were any more comments for the Open Port.ion. <br />Dr. Suit, 935 Beech Hill Road - said he was informed by Mayor Beebe earlier this <br />evening that Beech Hill is not a dedicated and accepted.street and asked if <br />Council could make a f inding so they know one way or another whether Beech Hiil <br />is an accepted and dedicated street. Mayor Beebe said he said the street was dedicated but not.accepted to the best <br />of his knowledge. <br />Mr. Feneli said the road was accepted for public use but has never been accepted ? <br />for maintenance. As he recalls, it was never put in such a condition that the <br />Village accepted it formally by ordinance. <br />Dr. Suit said when he checked the records he found the.street was dedicated and <br />accepted. According-to the records, it states once a street is accepted the <br />municipality is responsible for the street. <br />Mr. Feneli said this is wrong. Whether or not a road is.accepted for public <br />use and maintenance, when a road is repaved it is assessed.. Minor asphalt work <br />is usually paid for by the municipality, although it does not have to be. Ohio <br />law provides a procedure where the cost can be passed on to the abutting property <br />owners because it directly improves the value of their property by having a <br />paved roadway.
